"Two Principles for Handling Violations in Air Transport Operations"

Recently, the Ministry of Transport issued Circular 85/2015/TT-BGTVT regulating responsibilities and handling violations in aviation transport operations.

Circular 85/2015/TT-BGTVT stipulates the principles of handling violations in the field of air transport activities, including:

- The forms of handling violations stipulated in this Circular do not replace the legal provisions on administrative violation handling in the field of civil aviation.

- Organizations and individuals with authority must issue written warnings regarding violations, including the content and deadline for rectifying the violations, and the application of sanctions for failing to comply with the rectification requirements.

In addition, the Circular also stipulates the handling of violations for organizations operating in the field of air transport, and these organizations must comply with the following regulations:

- The Civil Aviation Authority of Vietnam shall issue the first warning immediately after detecting that an organization has not performed or has not fully performed the responsibilities corresponding to the provisions in Articles 5, 6, 7, and 8 of this Circular.- The violating organization will be placed on the list of enterprises that do not fully perform responsibilities related to air transport activities if it does not perform or does not adequately comply with the Civil Aviation Authority of Vietnam’s second warning on the same matter; the Civil Aviation Authority of Vietnam will place the violating organization on the list at the time of issuing the third warning and will remove it from the list once full compliance with the warning is achieved.- In addition to the handling of violations stipulated in Clause 2 of this Article, the violating organization may be suspended, have permits, licenses, or operating certificates revoked according to provisions of the law.
