"Should One Sign the Penalty Record or Not?"

The scene of arguments between citizens and traffic police officers (CSGT) over whether there is a violation of road traffic safety regulations not only disrupts public order but also leaves a negative impression on foreign tourists visiting Vietnam. In reality, such behavior does not exempt you from paying the fine; it is merely a meaningless action.

Walking along the street, encountering scenes of traffic police (CSGT) arguing with road users about whether a violation has occurred is no longer uncommon. But frankly speaking, that scene is not pleasant for either the road users or the CSGT. In fact, when caught in such situations, you can handle it in a more appropriate and civilized way.

We do not need to waste words trying to prove ourselves right. Because even if you are indeed right but refuse to sign the violation handling record, you still have to pay the fine. This is because Article 73 of the 2012 Law on Handling Administrative Violations stipulates that individuals and organizations that are penalized have the right to appeal and file a lawsuit against the penalty decision, but must still comply with the penalty decision, except where the enforcement of the penalty decision is temporarily suspended.

The mentioned suspension only applies when, during the process of resolving the complaint or lawsuit, it is deemed that the enforcement of the penalty decision will cause difficult-to-remedy harm.

Therefore, if you are fined by the traffic police, right or wrong, it should not be discussed immediately; just pay the fine first. Afterward, if you believe that the penalty was incorrect, you can file a complaint, accuse, or sue over the administrative violation handling. Specifically, Article 15 of the 2012 Law on Handling Administrative Violations stipulates as follows:

- Individuals and organizations being handled for administrative violations have the right to complain and file a lawsuit against the administrative violation handling decision in accordance with the law.- Individuals have the right to denounce unlawful acts in the handling of administrative violations in accordance with the law.

Through the above commentary, it is hoped that everyone will behave more properly when encountering similar situations. Remember that the law is not only a tool for the State to manage its citizens but also a means, a tool, for each citizen to protect their own rights.
