Rights and obligations of notary practice organizations accepting trainees (Illustration)
Circular 04/2015/TT-BTP stipulates the rights and obligations of notary practice organizations accepting trainees as follows:
1. Assign a qualified notary to guide the trainee and take responsibility for the assignment.
2. Create favorable conditions for the Trainee and the guiding notary at their organization.
3. Consider and decide on the refusal of the notary to guide the trainee, and the request of the Trainee to change the guiding notary.
4. Manage the Trainee during the training period at their organization; notify in writing to the Department of Justice no later than 5 days after the day the Trainee temporarily suspends the training; monitor and supervise the responsibilities of the guiding notary; ensure the exercise of rights and obligations of the Trainee; mediate disputes between the guiding notary and the Trainee.
5. Submit a written report to the Department of Justice on the acceptance and guidance of the trainee at their organization on an annual basis. The report includes the following main contents:
- Number of Trainees;- Assessment of the quality of the Trainee's apprenticeship;- Implementation of the rights and obligations of the notary practice organization, the Trainee and the responsibilities of the guiding notary in accordance with this Circular;- Difficulties and obstacles in the process of accepting trainees (if any) and recommendations.
6. Other rights and obligations as agreed with the Trainee or as prescribed by law.
