Publicize information about the capacity of organizations and individuals engaged in construction activities in Vietnam

Specifically, according to Article 15 of the Circular No. 39/2015/TT-BNNPTNT of the Ministry of Agriculture and Rural Development of Vietnam, organizations and individuals participating in bidding for bidding packages decided by the Ministry deciding investment must provide and update information about their capacity and experience in the database of contractors on the national bidding network system under Point k Clause 1 Article 8 and fully satisfy the conditions specified at Point d Clause 1 Article 5 and Point e Clause 2 Article 22 of the Law on Procurement No. 43/2013/QH13 of Vietnam.

Besides, project owners and investors regularly monitor, check and evaluate the capacity of organizations and individuals participating in bidding packages (survey, design, design verification, supervision and construction of works) under their management according to the regulations of the Ministry. Assessment results shall be published on the website of the Ministry of Agriculture and Rural Development of Vietnam and the Website of the Construction Management Department (http://xdcb.vn). The project owner and investor shall base themselves on the evaluation results and the provisions of Clause 1 Article 15 of the Circular No. 39/2015/TT-BNNPTNT as a basis in the contractor selection process.

Moreover, for a bidding package performed by a foreign contractor, within 15 days from the date of signing the contract with the foreign contractor, the investor and the project owner are responsible for sending a written report on the winning contractor's information under their management to the Ministry of Planning and Investment of Vietnam, the appraisal agencies of the Ministry and the Department of Planning and Investment in the locality where the project is implemented for consolidation and monitoring.
