Publicity and Transparency in Construction Investment Project Management

The Anti-Corruption Law Amendment 2012 was promulgated on November 23, 2012. This Law supplemented and amended certain provisions of the Anti-Corruption Law 2005. For instance, the amendment concerns the transparency and disclosure in the management of construction investment projects.

To be specific, according to Clause 3, Article 1 of the Law on Anti-Corruption, amended in 2012, which amends and supplements Article 24 of the Law on Anti-Corruption 2005, the contents of publicity and transparency in investment project management are regulated as follows:

- In the management of construction investment projects, the following contents must be made public and transparent:

- Pre-feasibility report, feasibility report, socio-economic impact assessment report; objectives, expected results, main activity groups and beneficiaries during the project formulation;- Project approval decision, project implementation plan;- Progress report, project implementation results report, project evaluation report and project completion report.

- Planning construction investment projects must seek opinions from the local population regarding the pre-feasibility report, feasibility report, socio-economic impact assessment report; objectives, expected results, main activity groups and beneficiaries during the project formulation and must disclose the following contents after approval:

- Project approval decision, project implementation plan;- Progress report, project implementation results report, project evaluation report and project completion report.

- Construction investment projects funded by local budgets must be reviewed and decided by the People's Council.

- Construction investment projects, after being decided and approved, must be disclosed according to the provisions at points b and c, clause 1, Article 14 of the Law on Anti-Corruption 2005 for public supervision.
