Public Information for People's Awareness

Ordinance on the Implementation of Democracy in Communes, Wards, and Commune-level Towns of 2007, issued on April 20, 2007. One of the notable contents of this document is the regulation on the information that must be publicly disclosed for the people to know.

To be specific, according to the provisions of Article 5 of the Ordinance on the Implementation of Democracy at Communes, Wards, and Commune-level Towns 2007, the contents that must be disclosed include:

  1. The socio-economic development plan, the economic restructuring plan, and the annual budget estimate and settlement of the commune level.

  2. Projects, investment works, and their priority order, implementation progress, compensation plans, land clearance support, and resettlement related to projects and works in the commune; detailed land use planning and plans and adjustment plans, and residential area planning in the commune.

  3. Duties and powers of commune-level officials directly resolving the people's affairs.

  4. Management and utilization of various funds, investments, and aids according to programs and projects for the commune; contributions mobilized from the people.

  5. Policies and plans to borrow funds for people to develop production, eradicate hunger and reduce poverty; methods and results of appraising poor households eligible for production development loans, social allowances, building charity houses, and issuing health insurance cards.

  6. Scheme for the establishment, merger, and division of administrative units, adjustment of administrative boundaries directly related to the commune.

  7. Results of inspections, examinations, and resolutions of negative and corrupt cases of commune-level officials and village or residential group officials; results of confidence votes for President and Vice President of the People's Council, President and Vice President of the People's Committee at the commune level.

  8. Contents and results of public opinions on issues under the decision-making authority of the commune level that the commune government puts out for public consultation according to Article 19 of this Ordinance.

  9. Subjects and levels of fees, charges, and other financial obligations collected directly by the commune government.

  10. Legal provisions on administrative procedures, resolving people-related affairs directly implemented by the commune government.

  11. Other contents as prescribed by law, as required by competent state agencies, or deemed necessary by the commune government.

The disclosure of these contents may be carried out through the following forms:

- Publicly posted at the office of the People's Council and the People's Committee of the commune;- Publicized via the commune's broadcasting system;- Publicized through the Village Head or Residential Group Leader to notify the people.

The commune government may adopt multiple forms of disclosure simultaneously and provide information in accordance with Article 32 of the Law on Anti-Corruption.
