Provisions on the Certification of Results of implementation of Scientific and Technological Tasks Not Using State Budget in Vietnam

Article 12 of Circular 02/2015/TT-BKHCN specifically stipulates the issuance of the Certificate of Confirmation of Results of Performing Science and Technology Tasks not Using State Budget in Vietnam as follows:

- Based on the conclusions of the Evaluation Council, within 05 working days from the date of receiving the evaluation minutes from the Council, the Head of the evaluating agency shall consider and decide on the issuance of the Certificate of Confirmation of Results of Performing Tasks not Using State Budget. In case of not issuing the Certificate, the evaluating agency shall notify in writing, clearly stating the reasons to the organization or individual.

- In case the Head of the evaluating agency disagrees with the evaluation results of the Evaluation Council, the evaluating agency must notify in writing to the requesting organization or individual (clearly stating the reasons for disagreement with the Council's conclusion) and shall reconsider and re-evaluate the results of task performance. The re-evaluation and response time to the requesting organization or individual shall be within 15 working days from the date of receiving the Evaluation Minutes from the Evaluation Council.

- The Certificate of Confirmation of Results of Performing Tasks represents the recognition of the state management agency regarding the results of the performing science and technology tasks by the organization or individual; it is encouraged to be used for the establishment and registration for certification as a science and technology enterprise in accordance with the law on science and technology enterprises.

- The organization or individual requesting the evaluation of task performance results commits to complying with the legal regulations on intellectual property and other relevant laws, and is responsible for the authenticity of the evaluation request dossier.

- Within 03 working days from the issuance of the Certificate of Confirmation of Results of Performing Tasks, the evaluating agency is responsible for posting information about the issuance on the electronic information portal of the unit. The posted information includes the information contained in the Evaluation Confirmation Certificate.

- If it is found that the organization or individual in charge of task performance or the organization or individual applying the task performance results provides untruthful information or falsifies the declared content in the evaluation request dossier, the competent authority issuing the Certificate of Confirmation of Results of Performing Tasks has the right to cancel the validity of the Certificate.
