Provisions on Plans for the Protection of Maritime Works

On December 14, 2017, the Government of Vietnam issued Decree 143/2017/ND-CP regulating the protection of maritime works.

In Article 8 of Decree 143/2017/ND-CP, the contents of the plan for the protection of maritime structures are stipulated as follows:

- Determining the scope of protection of maritime structures;- Establishing maritime signaling for maritime structures;- Personnel, addresses, and contact phone numbers for the implementation of maritime structure protection;- Means and tools for serving maritime structure protection;- Plan for the implementation of maritime structure protection and inspection, monitoring measures by the investor or manager of the exploitation of the structure;- Measures to handle damages, maritime accidents, incidents, or violations affecting safety in the exploitation of maritime structures;- Proposing principles, mechanisms, and methods of coordination between the investor or manager of the structure exploitation with the Maritime Port Authority and competent agencies in the area where the maritime structure is located.

Authority and responsibilities for developing, appraising, and approving the plan for the protection of maritime structures are stipulated as follows:

- For maritime structures under preparation for investment, the investor is responsible for organizing the development of the protection plan with the stipulated contents and adding it to the project dossier for submission to competent authorities for appraisal and approval along with the investment project.- For maritime structures already in operation and use but without a protection plan, the manager responsible for the operation and use of the maritime structure must organize the development of a protection plan with the stipulated contents, organize appraisal, approval, and implementation of the protection plan for the maritime structure.

The protection plan for maritime structures, after being approved by the investment or management organization or individual, must be sent to the Maritime Port Authority for inspection, supervision, and coordinated implementation.
