Provisions on Aviation Infrastructure Assets

Attention is drawn to Decree 44 with regulations related to aviation infrastructure assets. To be specific as follows:

Principles of management, use, and exploitation

- All aviation infrastructure assets are assigned by the State to be managed in accordance with the law;- State management of aviation infrastructure assets is carried out uniformly, with clear decentralization of authority, responsibility of each state agency, and coordination responsibility between state agencies; distinguish between the state management function of state agencies and the business activities of enterprises.- The management, use, and exploitation of aviation infrastructure assets are conducted based on market mechanisms; preserve and diversify capital sources; develop aviation infrastructure assets.- Aviation infrastructure assets are fully accounted for in physical and value terms, assets at high risk due to natural disasters, fires, and other force majeure causes are managed financially through insurance instruments or other tools as prescribed by law.- The management, use, and exploitation of aviation infrastructure assets must ensure publicity, transparency; be monitored, inspected, audited; all violations of the law on managing and using assets must be promptly and strictly handled according to the law.- Aviation infrastructure assets related to national defense and security are determined according to the law on protecting important works related to national defense and security.

Management of aviation infrastructure assets

- Aviation infrastructure assets that have accounted for state capital in enterprises are managed and used according to the law on managing, using state capital invested in production, business at the enterprise, specialized aviation law, and related laws.- Aviation infrastructure assets attached to the land, water surface that has not accounted for state capital at the enterprise are managed and used according to the law.

Decree 44/2018/ND-CP takes effect from March 13, 2018.
