On October 23, 2024, the Government of Vietnam issued Decree 137/2024/ND-CP regulating electronic transactions of state agencies and the information systems serving electronic transactions in Vietnam.

Provision of online public services and administrative procedures in Vietnam

Pursuant to Article 8 of Decree 137/2024/ND-CP, the provision of online public services and administrative procedures in the electronic environment is implemented as follows:

- Administrative procedures and public administrative services that are regulated or not regulated to be carried out by electronic means shall be implemented according to the Government of Vietnam's regulations on carrying out administrative procedures in the electronic environment and the Government of Vietnam's regulations on the provision of information and online public services by state agencies in the online environment, except where otherwise stipulated by other laws.

- Public administrative services are provided online in full process based on a review and restructuring process, meeting quality requirements according to the Government of Vietnam's regulations on implementing administrative procedures in the electronic environment, applying a one-stop-shop, interconnected one-stop-shop mechanism in resolving administrative procedures and providing information and online public services in the online environment.

- State agencies are responsible for resolving administrative procedures, providing full-process online public services when the conditions are met to complete the process entirely by electronic means. In cases where full implementation in the electronic environment is not yet achieved, state agencies must notify organizations and individuals accordingly.

- Administrative procedure dossiers and results are digitized according to the Government of Vietnam's regulations on implementing administrative procedures in the electronic environment and applying a one-stop-shop, interconnected one-stop-shop mechanism in resolving administrative procedures.

The results of resolving administrative procedures for organizations and individuals are delivered according to related legal regulations, while the electronic resolution results are issued at the Electronic Data Management Repository of organizations and individuals, on the national identification application as per the needs of organizations and individuals. In cases where organizations or individuals carry out administrative procedures through authorization, the storage of electronic results is executed according to the authorization agreement.

In cases where results are issued on paper, the competent authority shall convert them into data messages according to the provisions of Article 4 of Decree 137/2024/ND-CP and store them in related information systems and databases under their management authority; the converted results must be shared among state agencies and used as a component of the administrative procedures dossier to facilitate organizations and individuals in implementing other public services and administrative procedures.

- Public career services and public utility services are reviewed and restructured in their processes to provide online public services to individuals and organizations on the National Public Service Portal, the information system for resolving administrative procedures at the ministry or provincial level, and the electronic portal of the service providing organizations, as stipulated by the Government of Vietnam for implementing administrative procedures in the electronic environment, applying a one-stop-shop, interconnected one-stop-shop mechanism in resolving administrative procedures and providing information and online public services in the online environment.

- Ministries, equivalent agencies, agencies under the Government of Vietnam, and the People's Committee at the provincial level must review, issue, and implement plans to provide online public career and utility services within their management scope.

- The Ministry of Information and Communication is responsible for maintaining, operating, upgrading, and ensuring information security for the monitoring and measuring system of the Government of Vietnam's digital service provision and usage to monitor and measure the provision of online public services; to inspect and evaluate the deployment of interactive electronic forms of online public services and the data sharing between state agencies providing online public services in Vietnam.

- The Office of the Government of Vietnam guides the review and restructuring of procedure processes to target the provision of full-process online public services; evaluates the quality of service to individuals and organizations in implementing administrative procedures and providing public services by ministries and central authorities, and the People's Committee at the provincial level; maintains, operates, upgrades, and ensures information security for the service quality evaluation index system for citizens and businesses on the National Public Service Portal.
