Protection of new plant varieties according to the Ordinance on plant varieties 2004 of Vietnam

The Ordinance on plant varieties 2004 of Vietnam was issued on March 24, 2004, of which one of the most notable contents is the regulation on protection of new plant varieties.

Specifically, according to Article 20 of the Ordinance on plant varieties 2004 of Vietnam, protection of new plant varieties must follow the following principles: 

- The State protects the ownership, copyright over new plant varieties in the form of granting new plant variety protection titles.

- The Ministry of Agriculture and Rural Development is the agency performing the State management over the protection of new plant varieties nationwide.

- The protection of new plant varieties must comply with the provisions of this Ordinance, the legislation on intellectual property and other relevant law provisions.

Conditions for new plant varieties to be protected are as follows:

- Being on the list of State-protected plant varieties, promulgated by the Ministry of Agriculture and Rural Development.

- Being distinct, uniform and stable.

- Being commercially novel.

- Having appropriate names as prescribed in Article 17 of this Ordinance.
