Regarding this matter, LawNet would like to answer as follows:

Recently, the Ministry of Education and Training has sought feedback on the Draft Law on Teachers. It is clear that the teaching profession is a noble one in today's society. However, there have been some unfortunate cases that have had a negative impact on the teachers. Therefore, the Draft Law on Teachers also proposes certain duties and prohibited behaviors for teachers.

Proposed duties of and prohibited behaviors for teachers in Vietnam in Vietnam

According to the proposals in the Draft Law on Teachers, teachers in Vietnam have the following duties:

- Set an exemplary model for implementing the Communist Party of Vietnam's guidelines, policies, and the State's laws, as well as the rules and regulations of educational institutions.

- Teach and educate according to the educational goals and principles; fully and effectively implement the educational curriculum.

- Maintain the qualities, prestige, honor, and professional ethics of teachers.

- Respect and treat learners fairly; protect the legitimate and lawful rights and interests of learners; and develop the qualities and capabilities of each learner.

- Regularly cultivate, train, and study to enhance professional qualities and competencies.

- Fulfill the task of scientific research for lecturers, participate in research and application of applied pedagogical science for teachers; ensure academic integrity.

- Update skills in applying information technology, and the ability to develop advanced educational programs and methods.

- Participate in monitoring educational institutions; build a safe educational environment.

- Keep in touch with students' families; actively participate in community service activities.

- Respect and cooperate with colleagues.

- Other obligations as stipulated by law and the regulations of the educational institutions.

In addition, the Ministry of Education and Training of Vietnam also proposes the following prohibited behaviors for teachers:

- Infringe the dignity, honor, or physical integrity of students, colleagues, and the people.

- Discriminate against students in any form.

- Commit fraud or deliberately distort results in admissions, examinations, tests, and student assessments.

- Distort educational content; abuse teaching and education activities to propagate content that goes against the Communist Party of Vietnam's guidelines, the State's policies and laws, or to propagate hostile policies, causing division in national unity.

- Force students to participate in extra classes in any form, or collect fees beyond legal regulations.

- Abuse the teacher's title and teaching/education activities to violate the law; allow others to use the teaching practicing license in any form.

- Violate the code of ethics for teachers and other prohibited acts as stipulated by law.

The Ministry of Education and Training of Vietnam also proposes the following prohibited behaviors for organizations and individuals towards teachers:

- Infringe the honor, dignity, or physical integrity of teachers.

- Obstruct the professional activities of teachers.

- Assign teachers not in accordance with the agreement or commitment in the employment contract; assign tasks beyond the working hours stipulated by labor laws.

- Discriminate between teachers in any circumstance.
- Pay an incorrect amount and/or not in the time period specified in the employment contract; not fully and promptly implement the regimes and policies for teachers as stipulated.

- Publicly disclose information about teacher misconduct before the official conclusion of the competent authority during the disciplinary review or legal liability investigation process.
