Draft Law amending Law on Citizen Identification

To discontinue the use of identity cards as of January 1, 2025 in Vietnam (proposal)

According to Article 45 of the Draft Law amending Law on Citizen Identification, valid ID cards issued before the effective date of the amended Citizen Identification Law can be used until December 31, 2024.

Legal documents issued using information from the Identity Card remain legally valid. State management agencies are not allowed to regulate procedures for correcting or changing information related to ID cards and citizen identification cards in the above documents.

Thus, it is expected that the ID card will only be valid until December 31, 2024, and will be deactivated on January 1, 2025.

What is an electronic citizen identification card?

The draft revised Citizen Identification Law mentions electronic Citizen Identification in Article 31 of the Draft, accordingly:

- Electronic citizen identification card is an electronic identification account containing information printed on the card, information integrated into the card, and other citizen informationin the electronic identification and authentication system.

- Electronic identification accounts created by the electronic identification and authentication system are used to carry out administrative procedures, public administrative services in the electronic environment, and other transactions and activities according to the needs of the electronic identity subject.

- When the electronic identity subject uses the electronic identity account in electronic activities and transactions, it has the same value as presenting papers and documents to prove that information has been integrated into the electronic identity account.

* Value of using electronic citizen identification card

Article 34 of the Draft stipulates that electronic citizen identification cards have the same use value as using citizen identification cards in performing transactions requiring the presentation of citizen identification cards; valuable for providing information in citizens' documents that have been synchronized into the electronic identification account for comparison by competent agencies and organizations when performing transactions requiring the presentation of such documents.

23 types of citizen information in Vietnam National Population Database

Information about citizens in the National Population Database is specified in Article 10 of the Draft, including:

1. Surname, middle name, and birth name.

2. Personal identification number.

3. Date, month, and year of birth.

4. Gender.

5. Place of birth registration.

6. Hometown.

7. Ethnicity.

8. Religion.

9. Nationality (Vietnamese)

10. Marital status.

11. Place of permanent residence.

12. Temporary shelter.

13. Status of reporting a temporary absence.

14. Current residence.

15. Relationship with the head of household.

16. Blood type.

17. Identity card number/Citizen identification card, date of issue, place of issue, validity period.

18. Full name, middle name, personal identification number or ID card number, nationality of father, mother, wife, husband, or legal representative.

19. Full name, middle name, first name, personal identification number, or ID card number of the head of household and household members.

20. Date, month, year of death or disappearance.

21. Full name, middle name, first name, personal identification number or ID card number of the guardian and ward.

22. Information on policy areas (labour - war invalids, social affairs; education - training; health; insurance).

23. Other information is shared from national databases and specialized databases.
