Content mentioned in the Draft Decree amending Decree 101/2020/ND-CP amending Decree 123/2016/ND-CP on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies.
Specifically, the proposed amendments are as follows:
- Amend and supplement Clause 7 on the number of deputies of the head of a branch of a department under the ministry; the branch belongs to the department under the general department under the ministry.
+ Evaluate difficulties and shortcomings:
Some branches organize and operate with specific characteristics: (1) Handling administrative procedures 24/7; (2) assigning regional and inter-regional management; (3) If there is a large scale, many affiliated organizations, more than 11 organizations... then the regulation is to only assign a maximum of no more than 02 deputies, which will make it difficult to meet the job requirements.
+ Proposal to amend and supplement Clause 7, Article 1 (addition of Point c, Clause 2, Article 18b) as follows:
“Article 18b. Criteria for establishing branches and equivalents (hereinafter referred to as branches), number of deputies of the head of the branch
2. Regarding the number of deputies of the head of a branch of a department under a ministry:
a) Branches with from 01 to 03 departments are assigned 01 deputy; There are 04 or more departments, and no more than 02 deputies;
b) The branch does not have a room with no more than 02 deputies;
c) The Branch is assigned no more than 03 deputies when meeting one of the following criteria:
- There are 11 or more affiliated organizations;
- Assigned to manage inter-provincial and inter-district areas with 09 or more affiliated organizations;
- Assigned to handle administrative procedures 24/7.
3. Establishment criteria and the number of deputies of the head of a branch of a department under a general department of a ministry shall comply with the regulations on establishment criteria and the number of deputies of the head of a branch of a department of a ministry. Ministers and heads of ministerial-level agencies shall decide or authorize the General Director to decide on the number of deputies of the head of the branch as prescribed in Point c, Clause 2 of this Article, ensuring that each branch has no more than 03 deputies on average.
- Amend and supplement Clause 12 on the number of deputies of the heads of departments, bureaus, inspectors, and offices of the general department of the ministry.
+ Assessment of difficulties and inadequacies: Some Departments are vertically organized and located locally, have a wide management scope, have many payrolls, and handle administrative procedures 24/7 such as tax, customs, etc. Only being assigned a maximum of no more than 03 deputies will make it difficult to meet job requirements.
+ To overcome the above problem and ensure the total number of deputies is not increased according to the criteria specified in Decree 101/2020/ND-CP (reported to the Politburo in Report No. 692-TTr/BCSĐCP), proposed to amend and supplement Clause 12, Article 1 as follows:
“5. Number of deputies of the heads of departments, bureaus, inspectors, and offices of the general department of the ministry:
a) Departments under the General Department have from 15 to 20 civil servants staffed with no more than 02 deputy levels; there are more than 20 civil servant payrolls with no more than 03 deputies;
b) Departments, inspectorates, and offices under the General Department with less than 04 organizations are assigned no more than 02 deputy levels; There are 04 or more organizations assigned no more than 03 deputies;
c) Locally located departments under the General Department are organized according to a vertical system with no more than 03 deputy levels;
d) For departments, bureaus, inspectorates, and offices under the general department organized according to a vertical system with affiliated departments located locally according to the provisions of law and meeting the conditions for arranging no more than 03 deputies according to the provisions of Points a, b or c of this Clause based on the requirements of state management tasks, Ministers and Heads of ministerial-level officials shall decide on the average number of deputies of each organization to be no more than 03 deputies.
