Proposal for supporting policies for Vietnamese guest workers (Internet image)
The Ministry of Labor - Invalids and Social Affairs is seeking opinions on the draft Law on amendment to the Law on Employment.
According to Article 31 of the draft Law on amendment to the Law on Employment, the proposal for supporting policies for Vietnamese guest workers is as follows:
- The state encourages and creates conditions for workers who have the need and ability to work abroad.
- Workers who belong to ethnic minorities; poor households, near-poor households; those whose land has been recovered; relatives of people who have contributed to the revolution; young people who have completed military or police service, voluntary young people after completing programs, projects, initiatives, or young intellectuals after completing their tasks at economic-defense areas; laborers in poor districts, especially disadvantaged communes, coastal and island areas who have the need to work abroad will be supported by the state:
+ Language training; understanding Vietnamese customs, laws, and the laws of the receiving country;
+ Training and improving the level of professional skills; assessing and issuing national professional skills certificates for workers to meet the requirements of the receiving country;
+ Providing loans for working abroad as regulated in Chapter II, Section 3 of the draft Law on amendment to the Law on Employment.
- The government will provide detailed regulations on paragraph 2 of Article 31 of the draft Law on amendment to the Law on Employment and the recognition of the professional skills of workers between Vietnam and the receiving country.
Currently, according to Article 20 of the Law on Employment 2013, the regulations on support for guest workers are as follows: - The State shall encourage and create conditions for workers who have demand and ability to go abroad as guest workers. - Workers who are ethnic minority people, members of poor households or households living just above the poverty line or households having agricultural land recovered, and relatives of people with meritorious service to the revolution who wish to go abroad as guest workers, are entitled to the State’s support for: + Vocational training and learning foreign languages; getting familiarized with the customs, habits and laws of Vietnam and the host country; + Training to improve occupational skills qualifications to meet the requirements of the host country; + Taking loans with preferential interest rates. |
Proposal for new policies to support employment in the context of market crises, economic recessions, natural disasters, or pandemics in Vietnam
According to Article 32 of the draft Law on amendment to the Law on Employment, based on the socio-economic conditions in each period and the ability to balance the budget, the state will develop and implement policies to support workers and employers in the event of crises, economic recessions, natural disasters, fires, or dangerous epidemics.
According to Article 33 of the draft Law on amendment to the Law on Employment, the proposal is to support elderly workers who are still capable of working and have the need for employment. The state will provide the following support:
- Training and improving the level of professional skills;
- Assessing and issuing national professional skills certificates;
- Providing free job counseling and job referrals;
- Providing loans to support the creation, maintenance, and expansion of employment as regulated in Chapter II, Section 2 of the draft Law on amendment to the Law on Employment.
Article 34 of the draft Law on amendment to the Law on Employment proposes that the state support the formalization of informal employment through the following activities:
- Providing labor market information, job counseling, and job referrals;
- Providing vocational training for informal workers and employers who hire or utilize informal labor;
- Assessing and issuing national professional skills certificates;
- Participating in voluntary social insurance as regulated by the laws on social insurance;
- Providing legal consultation and assistance as regulated by the laws on legal aid;
- Providing loans for job creation, maintenance, expansion, and working abroad from loan funds for employment as regulated in Chapter II, Sections 2 and 3 of the draft Law on amendment to the Law on Employment.
