The Ministry of Public Security (Hanoi, Vietnam) is drafting a Decree detailing several articles and measures for implementing the Law on management and use of weapons, explosives and combat gears.

Proposal for regulations on lethal knives in Vietnam

Prohibited Acts in production, trading, import, export, transport and use of highly lethal knives in Vietnam

Article 3 of the draft Decree proposes regulations on prohibited acts in the production, trading, import, export, transport and use of highly lethal knives in Vietnam as follows:

- Production, business, export, or import of highly lethal knives with unclear origins or without labeling the production facility and trademark on the product.

- Failure to take safety measures in the production, trading, import, export, transport and use of highly lethal knives.

- Failure to report the loss or misplacement of highly lethal knives during production, business, export, or import processes.

- Bringing highly lethal knives into prohibited zones, protected areas, crowded places, or public places without demonstrating a legitimate professional purpose, or if bringing highly lethal knives into crowded places or public places for legitimate professional use without proper wrapping, storage, management, and safety measures.

Safety Measures in production, trading, import, export, transport and use of highly lethal knives in Vietnam 

According to the draft Decree, it also proposes regulations on safety measures in the production, trading, import, export, transport and use of highly lethal knives as follows:

- Organizations, enterprises, or individuals producing highly lethal knives must implement safety measures as follows:

+ Lethal knife products must be labeled with the trademark and name of the production facility.

+ During the production process, safety, fire prevention, environmental protection, and strict management measures must be ensured to prevent loss or misplacement. In case of loss or misplacement, it must promptly be reported to the commune, ward, or commune-level town police where the organization or enterprise is headquartered or residing.

+ Knife products intended for sale to organizations, enterprises, or individuals for large-scale business or export must be packaged and boxed. If sold to individuals for personal use, the product must be securely wrapped to ensure safety and prevent misuse.

- Organizations, enterprises, or individuals in business of highly lethal knives must implement safety measures as follows:

+ At sales locations, highly lethal knives on display must be stored in display cases. If a display case is unavailable, other secure methods must be used to prevent misuse.

+ If the business does not have a fixed location, highly lethal knives must be stored securely in cabinets or fastened on transportation vehicles to ensure safety and prevent misuse.

- Organizations, enterprises, or individuals exporting or importing highly lethal knives must implement safety measures as follows:

- Organizations or enterprises exporting or importing highly lethal knives must comply with the law.- Lethal knife products must have their origin, name of the production facility, and trademark or serial number (if any) labeled on them.

- Organizations, enterprises, or individuals transporting highly lethal knives for business, export, or import must implement safety measures as follows:

+ When transporting highly lethal knives for business, export, or import, a separate and secure transportation vehicle must be used. In cases of transporting small quantities on other means of transport or passenger vehicles, strict management and safety measures must be ensured.

+ Highly lethal knives must be securely packaged and fastened to prevent loss or misplacement during transportation.

- Individuals using highly lethal knives must implement safety measures as follows:

+ When transporting or carrying highly lethal knives for use in labor, production, or daily activities, they must be securely wrapped or stored to ensure safety.

+ When bringing highly lethal knives into crowded places or public places for legitimate professional use, they must be securely wrapped, stored, and strictly managed to prevent misuse.

+ During professional use, measures must be taken to ensure safety and prevent loss or misuse by others for illegal purposes.
