Promulgating New Standards for the Appointment of Bailiffs Effective from February 24, 2020

This is an important regulation according to Decree 08/2020/ND-CP issued by the Government of Vietnam stipulating the organization and operation of Bailiff services.

from February 24, 2020, Enforcers when appointed must fully meet the mandatory standards stipulated in Article 6 of Decree 08/2020/ND-CP as follows:

- Be a Vietnamese citizen not older than 65 years, residing in Vietnam, compliant with the Constitution and laws, with good moral character.

- Have a bachelor's or postgraduate degree in law.

- Have at least 3 years of legal work experience at agencies or organizations after obtaining a bachelor's or postgraduate degree in law.

- Graduate from a training course, be recognized as equivalent to training, or complete a refresher course in the Enforcer profession as stipulated in Article 7 of this Decree.

- Meet the requirements of the results of the Enforcer internship examination.

Individuals meeting these standards may submit directly or send via postal system 01 application dossier for the appointment of Enforcer to the Department of Justice where they register for internship. The application dossier includes:

- Application form for Enforcer appointment as prescribed by the Minister of Justice;- Judicial record slip issued within 06 months up to the date of application submission;- Certified copy or copy accompanied by the original bachelor's or postgraduate degree in law for verification;- Documents proving legal work experience including: recruitment decisions, employment contracts, or labor contracts accompanied by documents proving social insurance payment period; documents proving dismissal, certificate revocation, or card revocation in cases specified in Clause 2, Article 11 of Decree 08/2020/ND-CP; documents proving retirement or resignation in cases specified in Clause 3, Article 11 of Decree 08;- Certified copy or copy accompanied by the original certificate of results of the Enforcer internship examination for verification.

The applicant for Enforcer appointment must pay the appraisal fee for the standards and conditions for practicing the Enforcer profession as prescribed by laws on fees and charges.
