Here is a noteworthy provision stipulated in Circular 170/2016/TT-BQP regulating the military ranks of professional servicemen corresponding to salary levels, promotion, demotion, and reduction of military ranks in cases of disciplinary action resulting in a salary downgrade; the order, procedures, and authority for decisions regarding professional servicemen, defense workers, and defense public employees.
The promotion of military rank for professional soldiers upon salary increase is regulated by Circular 170/2016/TT-BQP as follows:
- Professional soldiers are promoted in military rank when the current rank is lower than the rank corresponding to the increased salary level stipulated in Article 4 of Circular 170.- In cases where the current military rank is equal to the highest rank as specified in Clause 2, Article 16 of the Law on Professional Soldiers, Defense Workers, and Defense Public Employees, only salary increases or seniority allowances beyond the limit are considered, and military rank promotion is not.- In cases where the current military rank is higher than the highest rank as specified in Clause 2, Article 16 of the Law on Professional Soldiers, Defense Workers, and Defense Public Employees, it is preserved.
