The Competition Law 2018 was promulgated by the National Assembly on June 12, 2018, and officially came into effect on July 1, 2019. This law specifically stipulates prohibited unfair competition practices in business activities.
The following acts of unfair competition are prohibited in business activities:
- Infringement on business secrets in the following forms:- Accessing or collecting business secrets against the confidentiality measures of the information owner;- Disclosing or using business secrets without the permission of the information owner.
- Forcing customers or business partners of other businesses through acts of threat or coercion to compel them to cease or refrain from transacting with those businesses;- Providing untruthful information about other businesses by directly or indirectly disseminating false information affecting the reputation, financial status, or business operations of those businesses;- Disrupting the business operations of other businesses by directly or indirectly obstructing or interrupting their legitimate business activities;- Illegally enticing customers through the following forms:- Providing false or misleading information to customers about a business, its goods, services, promotions, or transaction conditions related to its goods or services to attract customers from other businesses;- Comparing one's own goods or services with similar goods or services of other businesses without substantiating the claims.- Selling goods or providing services below the total production cost leading to or likely leading to the exclusion of other businesses from the market for those goods or services;- Other acts of unfair competition prohibited under other laws.
This content is stipulated in Article 45 of the Competition Law 2018.
