Prohibited Product and Goods Categories for Advertising

Advertising is one of the effective business methods, contributing to bringing a company's products and goods closer to consumers. However, not all goods are permitted to be advertised, which means there are certain types of goods that are prohibited from advertisement according to Vietnamese law.

According to the provisions of Article 7 of the Advertising Law 2012, the types of products, goods, and services PROHIBITED from advertising include:

- Goods and services prohibited from trading as regulated by law;- Tobacco;- Alcohol with an alcohol concentration of 15 degrees or higher;- Breast milk substitutes for children under 24 months old, supplementary nutritional products for children under 06 months old; feeding bottles and artificial teats;- Prescription drugs; non-prescription drugs advised by competent state authorities to restrict use or to be used under the supervision of medical practitioners;- Products and goods with a sexual stimulation nature;- Hunting guns and ammunition, sports weapons, and products and goods with a nature of provoking violence;- Other products, goods, and services prohibited from advertising as prescribed by the Government of Vietnam when occurring in practice.

From the types of products and goods prohibited from advertising above, certain characteristics of those products can be discerned, such as:

- Belong to types of goods prohibited from trading under Vietnamese law;- Products still allowed for trading but need to be restricted due to being unhealthy and requiring limited use;- Goods with a nature of provoking violence.

If there is a violation of advertising regulations for products, goods, or services prohibited from advertising, the violator may be fined up to VND 100 million for individuals and VND 200 million for organizations, accompanied by remedial measures such as mandatory removal, dismantling, or deletion of violating advertisements, according to the provisions of Article 50 of Decree 158/2013/ND-CP.
