On September 18, 2024, the Central Executive Committee issued Regulation 183-QD/TW on the protection of agencies, organizations, and law enforcement officer in investigation, prosecution, trial, and judgment execution activities in Vietnam.

Prohibited acts of violating and infringing agencies, organizations, and law enforcement officer in legal procedures and execution of judgments in Vietnam

- Violating, threatening to violate the security, safety, order, prestige, and dignity of the working headquarters of competent agencies, organizations in procedural and judgment execution activities and the locations where these activities take place.

- Violating, threatening to violate the safety of assets, files, documents, means, and working equipment of competent agencies, organizations in procedural and judgment execution activities and detention facilities, warehouses protecting evidence, documents, items, and assets related to cases.

- Cyber attacks, data transmission interference, misappropriation of information, electronic data of competent agencies, organizations in procedural and judgment execution activities.

- Leaking information about the activities of agencies, organizations, law enforcement officer in procedural and judgment execution activities, affecting procedural and judgment execution activities, or revealing information that must be kept confidential during protection according to the Communist Party’s regulations and the state’s laws.

- Complaining, accusing, reflecting, spreading information with fabricated, false content aiming to incite, defame, falsely accuse, slander, insult the prestige, dignity, honor of agencies, organizations, and law enforcement officer in procedural and judgment execution activities, or negatively impacting the work position and employment of law enforcement officer.

- Abusing, misusing one's position, authority, or the influence of someone with authority to retaliate, oppress, negatively impact the work position, employment, or intervene, obstruct, or influence law enforcement officer in procedural and judgment execution activities to act against regulations.

- Directing, coercing, enticing, luring, bribing law enforcement officer in procedural and judgment execution activities to conceal, not report, falsely report, incompletely report, fail to execute or execute improperly procedural duties.

- Collecting, storing, exploiting, using, providing, sharing, publicly disclosing information, infringing agency, organization data or personal data of law enforcement officer in procedural and judgment execution activities contrary to legal provisions; posting, spreading fabricated, false information, images, documents aiming to incite, defame, falsely accuse, slander, insult, violate the dignity, prestige of agencies, organizations or insult the prestige, honor, dignity of law enforcement officer in procedural and judgment execution activities.

- Violating, threatening to violate the life, health, assets, and other legitimate rights and interests of law enforcement officer and their family members in procedural and judgment execution activities.

- Negligence, intentional delay in leadership, directing, executing the protection work for agencies, organizations, and law enforcement officer in procedural and judgment execution activities.

- Other prohibited acts as prescribed by the Communist Party of Vietnam and the state’s laws.

More details can be found in Regulation 183-QD/TW which comes into force in Vietnam from September 18, 2024.
