Prohibited acts in the protection of persons participating in anti-corruption and negative conducts in Vietnam

On January 17, 2025, the Central Executive Committee of Vietnam issued Regulation 231-QD/TW concerning the protection of individuals advocating against corruption and wasteful practices.

According to Article 8 of Regulation 231-QD/TW, the following acts are prohibited in the protection of anti-corruption, waste, and negative practice advocates:

- Using violence, exerting pressure, slandering, isolating, insulting or infringing upon the rights and legal interests of anti-corruption, waste, and negative practice advocates and their relatives.

- Illegally invading residences, seizing, destroying property, insulting dignity, honor, or taking actions that affect the personal health and safety of anti-corruption, waste, and negative practice advocates and their relatives.

- Retaliating or hiring, enlisting, or inciting others to threaten or retaliate against anti-corruption, waste, and negative practice advocates and their relatives.

- Performing inconsistent conduct, discrimination, setting criteria, conditions, comments, or assessments that impose disadvantagement in personnel work, commendation, or discipline towards anti-corruption, waste, and negative practice advocates and their relatives; transferring, deploying, or seconding them while addressing the case.

- Causing difficulties or obstructing the implementation of the policies, regulations of the Communist Party, State law, handling administrative procedures, public services, production and business activities, careers, jobs, labor, study, or task execution of anti-corruption, waste, and negative practice advocates and their relatives.

- Blocking, destroying information, documents, evidence of anti-corruption, waste, and negative practices; concealing, not reporting, delaying or handling, and verifying protection requests inconsistently; disclosing information that needs to be kept secret during protection; not promptly directing, resolving difficulties, and obstacles of organizations, individuals executing protection duties; not replacing protection duty members when there is evidence of irresponsibility, lack of objectivity in task execution.

- Misappropriating anti-corruption, waste, and negative practice advocacy activities to slander agencies, organizations, or individuals.

- Other prohibited acts under the regulations of the Communist Party and State law.

Principles of implementing protection of persons participating in anti-corruption and negative conducts in Vietnam

According to Article 3 of Regulation 231-QD/TW, the principles for implementation are defined as follows:

- The Party committee, Party organization, and head must promptly direct and resolve within their authority information on anti-corruption, waste, and negative practice advocacy; ensure confidentiality of information and documents according to the law, ensuring comprehensive leadership and direction by the Communist Party in the protection of anti-corruption, waste, and negative practice advocates.

- Anti-corruption, waste, and negative practice advocates, and their relatives are entitled to immediate protection measures ensuring safety; their legal rights and interests are protected.

- Proactively prevent, detect, promptly thwart, and strictly handle organizations and individuals threatening, retaliating, or oppressing anti-corruption, waste, and negative practice advocates, as well as those exploiting anti-corruption activities to distort the truth, slander, or disrupt unity.
