Prohibited acts in the organization and personnel work of the inspection sectors in Vietnam

Bribery, acceptance of bribes, or suggesting acceptance of bribes is one of the prohibited acts in the personnel organization work as stipulated in Circular 05/2011/TT-TTCP on anti-corruption regulations in the inspection sector issued by the Government Inspectorate of Vietnam on January 10, 2011.

According to Article 19 of Circular 05/2011/TT-TTCP, the following acts are strictly prohibited in organizational and personnel work in Vietnam:

  • Bribery, accepting bribes, or suggesting bribery in any form;
  • Unfounded, dishonest, and biased evaluations and assessments of personnel;
  • Recruitment, reception, appointment, rotation, and transfer that do not follow the proper procedures; planning, training, rewarding individuals who do not meet the required standards and conditions;
  • Improper transfer, dismissal, relieving of duties, removal from office, disciplinary actions, and handling of policies;
  • Altering documents, dossiers of officials and public employees;
  • Abusing positions, powers, and work positions to illegally interfere in recruitment, reception, appointment, transfer, and other activities in organizational and personnel work;
  • Other prohibited acts as prescribed by law in organizational and personnel work.

Additionally, anti-corruption in organizational and personnel work in Vietnam must meet the following requirements:

  • Organizational and personnel work must be public, transparent, objective, and in accordance with the principle of democratic centralism.
  • The standards for each position must match the requirements of each job in terms of political qualifications, management expertise, technical skills, and professional competence; policies and compensation levels for each position must conform to general regulations and the specific conditions of each sector and locality.
  • Strict compliance with standards, policies, processes, and regulations on planning, reception, recruitment, appointment, dismissal, training, development, transfer, change of work positions, secondment, evaluations, personnel allocation, policy resolution, rewards, and disciplinary actions for officials and public employees based on clear responsibility and delegation.
