Prohibited acts in the application of compulsory rehabilitation measures in Vietnam

On December 30, 2013, the Government of Vietnam issued Decree 221/2013/ND-CP stipulating policies for the application of administrative handling measures to compulsory rehabilitation centers.

According to Decree 221/2013/ND-CP specifying the prohibited acts in the process of preparing records for requesting and executing the decision to apply the measure of sending persons to compulsory rehabilitation centers, the following acts are prohibited:

  1. Infringing upon the life, health, honor, and dignity of the person proposed for the application of the measure of sending to compulsory rehabilitation centers and the person subject to the decision to apply the measure of sending to compulsory rehabilitation centers.

  2. Abusing positions and powers to harass, solicit money, property or restrict the legal rights of the person proposed for the application of the measure of sending to compulsory rehabilitation centers and the person subject to the decision to apply the measure of sending to compulsory rehabilitation centers.

  3. Forging or falsifying records to propose the application of the measure of sending to compulsory rehabilitation centers; records proposing the postponement or exemption from executing the decision to apply the measure of sending to compulsory rehabilitation centers; records proposing the reduction of the term, temporary suspension, or exemption from serving the remaining time at compulsory rehabilitation centers.

  4. Exploiting or abusing labor, assigning product contracts to those executing the decision to apply the measure of sending to compulsory rehabilitation centers.

  5. Requesting or suggesting that persons executing the decision to apply the measure of sending to compulsory rehabilitation centers or their families contribute money or other materials beyond the provisions of the law.

  6. Extending beyond the duration of applying the measure of sending to compulsory rehabilitation centers as decided by the Court.
