Prohibited acts in resolving complaints and denunciations regarding corruption in Vietnam

This is an important content stipulated in Circular 05/2011/TT-TTCP Regulations on anti-corruption in the inspection sector issued by the Government Inspectorate of Vietnam on January 10, 2011.

Prohibited acts in resolving complaints and denunciations regarding corruption in Vietnam (Illustrative image)

Article 12 Circular 05/2011/TT-TTCP stipulates, the prohibited acts in the activity of resolving complaints and denunciations in Vietnam include:

- Harassing, obstructing the exercise of complaint and denunciation rights;

- Delaying the issuance of decisions to accept for resolution, verification, conclusion, recommendation to resolve complaints and denunciations;

- Falsifying case files during the process of verification, conclusion, recommendation to resolve complaints and denunciations; reporting verification results untruthfully;

- Concluding, recommending, issuing decisions to resolve complaints, making decisions to handle denunciations that are unlawful;

- Covering up the accused, the complained person; disclosing information about the whistleblower;

- Abusing the name of the agency, the head of the agency, the unit to handle personal work when performing the task of resolving complaints and denunciations;

- Other prohibited acts as prescribed by law in Vietnam.

Simultaneously, the activities of resolving complaints and denunciations about anti-corruption in Vietnam must ensure:

- Complaint and denunciation petition, and information reflected from various sources to the state inspection agency must be received, handled promptly, recorded, monitored, aggregated, and reported in accordance with the law;

- Verification must be conducted with the correct authority, procedures, promptly, cautiously, accurately, objectively, truthfully; verification documents must be compiled into a file;

- Verification result reports must be constructed openly, democratically; content must be truthful, objective, comprehensive;

- Conclusions, recommendations for resolution must be correct in content, right target, legally based, and feasible; protecting the interests of the State, legitimate rights, and interests of organizations and individuals; protecting the whistleblower according to legal provisions;

- Verification, conclusion resolve complaints, denunciations through the Inspection Team is carried out in accordance with regulations for inspection activities.

More details can be found in Circular 05/2011/TT-TTCP, which comes into force in Vietnam from March 7, 2011.
