Program for formulation of legislative documents related to security and order protection in Vietnam​ (Illustration)

In Article 14 of Circular 66/2011/TT-BCA, the program for building legislative documents issued by the Minister in Vietnam and jointly issued is stipulated as follows:

1. Based on the program for building legislative documents of the National Assembly, the Government of Vietnam, the demands and actual conditions of the fight against crime, state management of security and order protection, and the assigned tasks, the units shall submit their written proposals to draft circulars or joint circulars in the field of work in charge to the Legal Department by October 01 of the previous year at the latest.

2. The proposal for drafting circulars or joint circulars must clearly state: the name of the document; the presiding unit; the coordinating agencies or units drafting the document; the expected drafting time and submission of the document.

3. The Legal Department will collate the proposals for drafting circulars or joint circulars sent by the units, draft the Program for Developing legislative documents issued by the Minister and jointly issued annually; seek opinions from the units and Deputy Ministers to submit to the Minister by January 01 of the following year.

4. Based on the consideration of the dossiers presented by the Legal Department, the Minister approves and signs the issuance of the Program for Developing legislative documents issued by the Minister and jointly issued.

The adjustment of the program for developing legislative documents shall be carried out as follows:

- In cases where it is necessary to adjust the program for drafting laws, ordinances, or decrees (adding to the program, removing from the program, or adjusting the time for submitting the document), the drafting agency (or the proposing unit) shall send the proposal to the Legal Department to compile a report for the Minister to sign for submission to the Prime Minister the Government of Vietnam in accordance with Article 12 and Article 19 of Decree No. 24/2009/ND-CP and the provisions of this Circular.

- In cases where it is necessary to adjust the program for developing legislative documents issued by the Minister and jointly issued, the drafting agency (or the proposing unit) shall send the proposal to the Legal Department to compile a report for the Minister to review and decide.

More details can be found in Circular 66/2011/TT-BCA, which comes into effect in Vietnam from November 20, 2011.
