Process of Transporting Special Goods

On February 23, 2018, the Government of Vietnam issued Decree 21/2018/ND-CP, accompanying which are regulations on the process of transporting special goods.

Decree 21 Regulating the Organization for the Safety Protection of Special Goods during Transportation

Decree 21 stipulates the organization for the safety protection of special goods during transportation, from the moment of handover, receipt, and loading of special goods onto transport vehicles; during the transportation process; to the destination and completion of the handover at the destination.

During the transportation process, the following must be adhered to:

- Follow the correct transportation route for special goods, except for cases requiring changes due to legal regulations; comply with the provisions of the law on road, rail, inland waterway, and air traffic.- Do not carry unauthorized persons or anything other than special goods on the vehicle transporting special goods, except in cases of transporting special goods on inland waterway or air transport.- Vehicles transporting special goods are prioritized when passing through stations, bridges, ferries, tunnels, passes, toll stations, and are allowed to travel during peak hours.- Transport special goods during the day, except in the following cases, where based on actual conditions, the timing of special goods transportation should be arranged appropriately:- Transportation by rail or inland waterway vehicles;- Urgent cases to promptly meet monetary security requirements, or to address the aftermath of natural disasters, floods, and other necessary cases that require transporting special goods at night by road or air transport.- For multi-day transport trips by road, the special goods vehicle must be brought to the local special goods management agency's premises or the nearest Police or Military agency at night and arrange for safety protection forces.- In cases where it is necessary to change the time or place of stopping on the transportation route due to arising situations, incidents, or at the request of the Head of the transportation team, the Chief Commander of the People's Police force protecting the transportation vehicle shall be based on the actual situation to decide and notify relevant agencies, organizations, individuals on the transportation route to coordinate the safety protection of special goods.- Checkpoints and mobile patrol units enforcing the law on the transportation route must not inspect the special goods, vehicles, or any means engaged in transporting special goods on the road and at ports, ships, or stations.

In case of signs of legal violations or the occurrence of legal violations, report to the nearest Police station, report to the Director of the Provincial Police, central city where the violation occurred, or the head of the People's Police agency under the Ministry of Public Security with the function and task of protecting and transporting special goods for directive handling.
