Regarding this issue, LawNet would like to answer as follows:

On December 28, 2023, the Minister of Education and Training issued Circular 27/2023/TT-BGDDT which regulates the selection of textbooks in educational institutions.

The process of selecting textbooks in educational institutions as of February 12, 2024 is specified in Article 7 of Circular 27/2023/TT-BGDDT as follows:

(1) The council establishes a plan to organize the selection of textbooks in the educational institution and assigns tasks to council members.

(2) Organize the selection of textbooks in subject-specific groups:

- Based on the council's plan and the criteria for selecting textbooks, the head of the subject-specific group establishes a plan to organize the selection of textbooks for each subject taught in the group, and reports to the person in charge before implementation.

- Organize all subject teachers in the educational institution (including permanent, contractual, special, visiting, and inter-school teachers) to participate in the selection of textbooks for that subject.

- No later than 20 days before the first meeting of the subject-specific group, the head of the group organizes for subject teachers to study the textbooks for that subject, write evaluation notes, and evaluate the textbooks according to the criteria for selecting textbooks.

- The head of the subject-specific group organizes a meeting with subject teachers to discuss and vote on the selection of one textbook for that subject. In cases where there is only one textbook approved by the Minister of Education and Training for that subject, the subject-specific group selects the textbook as specified in the decision, without the need for voting.

The selected textbook must be approved by at least 1/2 (one-half) of the number of subject teachers who vote. In cases where no textbook reaches at least 1/2 (one-half) of the number of subject teachers who vote, the subject-specific group must discuss and vote again; the selected textbook is the one with the highest number of votes among subject teachers in the second voting round.

If there are two textbooks with the same number of votes from subject teachers in both voting rounds, the head of the subject-specific group decides to select one of the textbooks.

The meetings of the subject-specific group are recorded in minutes, which include full comments and evaluations of the selected textbooks by the participating subject teachers. The minutes must be signed by the head of the subject-specific group and the person assigned to prepare the minutes.

- The head of the subject-specific group consolidates the results and creates a list of selected textbooks, which is signed by the head of the subject-specific group and the person assigned to prepare the list.

(3) The council convenes a meeting to discuss and evaluate the organization of the textbook selection by the subject-specific groups; review the minutes of the subject-specific group meetings; the evaluation notes and comments on the textbooks by the teachers as specified in (2); consolidate the results of the textbook selection by the subject-specific groups into minutes (including the comments and evaluations of the organization of the textbook selection by the subject-specific groups; the list of selected textbooks by the subject-specific groups), which is signed by the Chairman and the Secretary of the council.

(4) The council proposes to the person in charge the list of textbooks that have been correctly selected by the subject-specific groups according to the regulations in Circular 27/2023/TT-BGDDT.

(5) The educational institution prepares a file of the selected textbooks and sends it to the Department of Education and Training (for primary and lower secondary levels) or the Department of Education and Training (for upper secondary level). The file includes:

- The decision to establish the council of the educational institution.

- Minutes of the council meeting as specified in (3).

- List of selected textbooks by the educational institution.
