On February 2, 2023, the Politburo of Vietnam issued Regulation 96-QD/TW on obtaining votes of confidence for leadership and management positions in the political system.

1. Process of obtaining votes of confidence for leadership and management positions in the political system in Vietnam

* For the positions of the party committee and the titles and positions of leadership and management in the political system:

Step 1: Prepare for the vote of confidence.

Based on the plan of the competent authority, the agency advising the organization and staff shall prepare the following contents:

- Request that the person who received the vote of confidence report in accordance with Clause 3 and Article 7 of this Regulation.

- Gather reports and dossiers of the person receiving the vote of confidence in accordance with regulations, and report explaining, providing information on relevant contents (if any), and sending it to the voter 15 days ahead of time.The contents and issues that need to be clarified at the request of the competent authority or the voter of confidence shall be sent to the person receiving the vote of confidence 10 days before the vote of confidence is collected.

- Prepare a vote of confidence with the list of people receiving the vote of confidence, the levels of confidence, and the hanging seal of the party committee, party organization, agency, or unit in accordance with regulations.

- Creating a vote-counting committee.

Step 2: Organize a vote of confidence

- The party committees, party organizations, heads of agencies, and units presiding over the conference thoroughly understand the purpose and requirements of taking votes of confidence from officials according to regulations.

- Electing the vote counting committee, which will distribute ballots and provide instructions on how to vote.

- Officers in the composition record and vote in the ballot box according to regulations.

Step 3: Report the result of taking the vote of confidence.

- The Vote Counting Committee shall count the votes and report the results to the conference.

- The vote counting minutes are made in three copies (two sent to immediate superiors and one kept at the locality, agency, or unit) and managed under the secret regime.

- Party committees, party organizations, agencies, and units that organize the collection of confidence votes shall report the results of taking confidence votes according to the provisions of Article 10 of this Regulation.

* For cadres elected or approved by the National Assembly and the People's Council:

Based on the above process, the National Assembly Party Committee leads its concretization and implementation.

2. Publication of the results of confidence votes for leadership and management positions in the political system in Vietnam

The results of the vote of confidence will be disclosed to the following groups and individuals:

+ Participants record the vote of confidence.

+ Competent authorities directly manage staff.

+ The person who receives the vote of confidence

- How to publicize the results of the vote of confidence:

+ Announcement at meetings to collect votes of confidence.

+ Members of the Politburo and the Secretariat must be made public in the Party's Central Committee.

+ For titles elected and approved by the National Assembly or the People's Council, they shall be publicized on the mass media for voters and the people to know.

+ For the remaining titles and positions in the political system, they shall be publicized at the conference to collect votes of confidence.

3. Use of the results of confidence votes for leadership and management positions in the political system in Vietnam

- The results of the vote of confidence are used to evaluate cadres, serve as a basis for planning, dispatching, appointing, and recommending cadres for election, dismissal, and implementation of regimes and policies toward cadres.

- In cases where there are more than 50% but less than 2/3 of the votes of confidence are low, the competent authority to manage cadres shall remove them from the higher planning positions; consider dismissing the current position, arrange another job; resign; or conduct a vote of confidence in accordance with regulations.

- In cases where two-thirds of the votes of confidence are low or more, the competent authority to manage the cadres shall relieve them of their positions and arrange for other (lower) jobs without waiting for the end of the term or the appointment period.

- For the person who gets a vote of confidence in two places, the credit rating of the officer will be decided by the competent authority on the basis of the overall review of the vote of confidence in each place.
