Process for Preparing and Appraising the Dossier of Pricing Plans for Air Transport Services

Circular No. 36/2015/TT-BGTVT stipulates the process for preparing and appraising the dossier on the pricing plan for domestic air transport services and specialized aviation services as follows:

- Organizations and individuals providing services shall prepare 02 sets of price plan dossiers and send them to the Civil Aviation Authority of Vietnam by one of the following methods:

- Send directly;- Send by official dispatch;- Send by email with an electronic signature or with a scanned copy of the Form with signature and red seal or send via fax and notify by phone, while also sending by official dispatch.

- The price plan dossier includes:

- Official Dispatch proposing pricing or price adjustment;- Price plan;- Other related documents.

The price plan dossier is specified in Appendix 1 issued with this Circular.

- Time limit for appraisal of the price plan and decision on price:

- No later than 15 working days from the date of receipt of a complete price plan dossier as prescribed, the Civil Aviation Authority of Vietnam shall have written comments on the content of the price plan. In case the price plan dossier is incomplete, within 03 working days, the Civil Aviation Authority of Vietnam shall issue a written request for the organization or individual to complete the dossier. The appraisal time is counted from the date of receipt of the complete dossier as prescribed.- A maximum of 10 working days from the date of receipt of the price plan with the comments of the relevant agency and the appraisal document from the Civil Aviation Authority of Vietnam, the Ministry of Transport shall decide the price. In case the price is not determined, the Ministry of Transport shall issue a written response.- In case it is necessary to extend the time for appraisal of the price plan or decision on price, the Civil Aviation Authority of Vietnam or the Ministry of Transport must notify in writing and state the reason for the extension to the organization or individual submitting the price plan; the extension period shall not exceed 15 working days from the deadline for price appraisal and decision as specified at points a and b of this clause.

- Price adjustment:

- When domestic and international price forming factors fluctuate affecting production and business activities, the Ministry of Transport shall promptly consider and adjust prices;- Organizations and individuals have the right to petition the Ministry of Transport to adjust prices in accordance with the law. When proposing a price adjustment, organizations and individuals must clearly state the reason and basis for determining the proposed adjustment price;- The order and time limit for price adjustment are carried out in accordance with the provisions of clauses 1, 2, and 3 of this Article.
