Regarding this issue, LawNet would like to answer as follows:

On December 9, 2022, Vietnam Social Insurance issued Decision 3612/QD-BHXH promulgating the process for settling one-time social insurance benefits, piloting authentication through integrated digital signatures. in applications on mobile devices according to Decision 422/QD-TTg dated April 4, 2022.

The process for handling one-time social insurance benefits and payments for the pilot authentication by digital signature on mobile phones in Vietnam is as follows:

1. Declaration and submission of documents for one-time social insurance benefits and payments in Vietnam

- The employee declares complete and accurate information according to Form No. 14A-HSB provided on the Public Service Portal, digitally signs Form No. 14A-HSB, uploads electronic records or cites documents from the individual's Electronic Data Management Warehouse and submits documents on the Public Service Portal.

Employees do not have to declare or resubmit data, records, and documents already in the database managed by the social insurance agency or that have been digitized, stored, connected, and shared by the competent authority with the Public Service Portal of the Electronic Single-Window Information System.

2. Receiving dossiers for one-time social insurance benefits and payments in Vietnam

- Single-Window software access department officer Receives and manages documents, receives documents transferred from the Public Service Portal, and checks the declared content in Form No. 14A-HSB, document components, accuracy of documents, and information on documents to perform:

+ In case the application is incorrect or does not have enough components, send notice Form No. 03/TB-GDDT issued with Decision 838/QD-BHXH to the employee on the Public Service Portal to complete the dossier according to regulations.

+ In case the documents are valid, notify the settlement of electronic transaction documents and return results for electronic transaction documents (Form No. 03/TB-GDDT issued with Decision 838/QD-BHXH) to workers and provide feedback on the processing status to the National Public Service Portal.

+ Transfer all received documents to the Social Insurance Benefits Department for processing.

- Receive the paper social insurance book sent by the employee when the lump-sum social insurance benefit has been settled, store it, or transfer it to the Archives Management Department according to regulations and documents that have been processed and received from the Division/Department of Social Insurance Benefits.

3. Settlement and preparation a list of one-time social insurance payments authenticated by digital signature on mobile phone in Vietnam

Officials of the Social Insurance Benefits Division/Department carry out:

- Receive documents from the software "Receive and manage documents", check and compare information as prescribed in Section 1.1.1, Point 1.1, Clause 1, Article 7, Chapter III, Decision 166/QD-BHXH.

- Access the Policy Management System (TCS) to review and submit to leadership for approval the Decision on one-time social insurance benefits (Form No. 07B-HSB) and the social insurance payment process (Form No. 04-HSB).

After being approved by the leader, transfer the release to the Single-Window department for paper copies (if the individual requests to return the results as paper copies), electronic copies or only electronic copies (if the individual requests to only return the electronic copies), Decision on one-time social insurance benefits and the social insurance payment process.

- Make a list of one-time social insurance payments according to the provisions of Clause 4, Article 1 of Decision 3503/QD-BHXH.

- Processing time: Maximum 05 working days from the date of receipt of complete and valid documents according to regulations.

4. Settlement of lump-sum social insurance payments in Vietnam

The Financial Planning Department/Department staff receives the list of C97-HD from the Social Insurance Benefits Department/Department and makes payments according to the provisions of Clause 6, Article 1 of Decision 3503/QD-BHXH.

Only make one-time payment for social insurance benefits (in cash or via personal account) after the person requesting settlement of benefits has received the Decision to enjoy one-time social insurance benefits, the social insurance book has the remaining unemployment insurance participation period (if any), and the person has returned the paper social insurance book.

Check and compare when paying one-time social insurance as follows:

- In case the beneficiary registers to receive one-time social insurance benefits directly in cash at the social insurance agency: On the basis of ID card/Passport that has been compared and authenticated by the Single-Window Department.

The Financial Planning Department checks and compares the beneficiary's signature on the application for one-time social insurance benefits (Form No. 14A-HSB) with the signature on the list of one-time social insurance benefit payments (Form No. C97-HD).

- In case of payment via personal account: pay via the employee's personal account. Before transferring money to the account, the Financial Planning Division/Department staff will contact the beneficiary by phone number to check the information and notify them of the one-time transfer of social insurance benefits for confirmation.

5. Return results of settlement of lump-sum social insurance benefits in Vietnam

The Single-Window Department carries out:

- Receive:

Documents that have been processed by the Social Insurance Benefits Department to be returned to the payer include: a decision on one-time social insurance benefits (Form No. 07B-HSB); a social insurance payment process (Form No. 04-HSB); an electronic social insurance book or paper social insurance book according to the registered method in the case of one-time social insurance benefits with an unpaid unemployment insurance payment period from the collection management Division/Department and a card book.

- Return results

After receiving the results of administrative procedures, the staff at the Single-Window Department calls directly and notifies the beneficiaries to receive the results in the registered form and instructs the beneficiaries to return the paper social insurance book. In case of receiving results at department one of the social insurance agency, when receiving the results, bring the ID card/passport for comparison and the paper social insurance book to submit to the social insurance agency.

+ In case the beneficiary registers to receive results directly at the social insurance agency

The officer returns the results to compare ID card/Passport/Personal account information (if received via personal account) according to the beneficiary's information on the file;

Scan ID card/Passport, digitally sign the scanned copy to keep records, ask the beneficiary to sign, and receive the result tracking book. Then inform the Financial Planning Division/Department to make a payment in cash or transfer money to the beneficiary's account (in the case of a payment in cash, instruct the beneficiary to receive it directly);

In case of a transfer to a personal account, timely information about the results is being returned to the beneficiary so that the Financial Planning Division/Department can make the transfer).

+ In case the beneficiary only registers to receive electronic results

The electronic copy is sent to the individual's electronic data management repository on the Public Service Portal.

Decision 3612/QD-BHXH takes effect on January 1, 2023.
