Procedures and documents for merger, dissolution, and naming and renaming of villages and residential groups in Vietnam 

This content is mentioned in the Draft Circular guiding the organization and operations of villages and residential groups in Vietnam.

The process and documents for merger, dissolution, and naming and renaming of villages and residential groups are proposed as follows:

1. The process and documents for merging villages and residential groups are applied and implemented as the procedures and documents for establishing new villages and residential groups specified in Article 8 of this Circular.

2. Pursuant to the Resolution of the National Assembly Standing Committee on the establishment of wards and towns from commune administrative units, the Chairman of the Provincial People's Committee decides to convert villages into residential groups under wards and towns.

3. For cases of dissolution of villages and residential groups

After implementing the Compensation, Support, Resettlement Plan or Population Arrangement and Stabilization Plan and other cases approved by competent authorities, the Provincial People's Committee prepares a Proposal with a list of households in relevant villages and residential groups to submit to the Provincial People's Council to decide on dissolution of the village or residential group.

4. Naming and renaming of villages and residential groups

- The naming of villages and residential groups is done in the process of preparing documents to establish new villages, new residential groups, or merge villages and residential groups;

- Changing the name of a village or residential group is carried out according to the following steps:

The commune-level People's Committee prepares a dossier, including: a proposal and plan to change the name of the village or residential group (the plan must clearly state the reason for changing the name of the village or residential group; new name of the village or residential group), organizes to collect opinions from all voters or voters representing households in the village or residential group on the plan to change the name of the village or residential group, synthesizes the opinions, and makes a minute to collect opinions.

If the plan to change the name of a village or residential group is approved by more than 50% of voters or voters representing households, the People's Committee at the commune level completes the dossier and submits it to the People's Council at the same level to approve the plan to change the name of the village and residential group; Within five working days from the date of the Resolution of the Commune-level People's Council, the Commune-level People's Committee completes the dossier and submits it to the District-level People's Committee. In places where commune-level People's Councils are not organized, within ten working days from the date of collecting opinions from voters or voters representing households, the Commune People's Committee completes the dossier and submits it to the District People's Committee.

In case the plan to change the name of a village or residential group has not reached the approval of more than 50% of voters or voters representing households, the commune-level People's Committee will organize a second consultation; If more than 50% of voters or voters representing households still do not agree, then within five working days from the date of the second opinion collection record, the Commune-level People's Committee reports to the District-level People's Committee for consideration and decision.

Within ten working days from the date of receipt of complete and valid documents transferred by the Commune-level People's Committee, the District-level People's Committee shall submit a Proposal (attached with the documents) to the Department of Home Affairs for appraisal;

Within ten working days from the date of receipt of complete and valid documents transferred by the District People's Committee, the Department of Home Affairs evaluates and reports to the Provincial People's Committee to submit to the People's Council at the same level to consider and promulgate a Resolution on changing the names of villages and residential groups.
