Process and documents for establishing new villages and new residential groups in Vietnam (proposal)

The content is mentioned in the draft Circular of the Ministry of Home Affairs on the organization and operation of villages and residential groups in Vietnam.

The process and documents for establishing new villages and new residential groups are as follows:

(1) Based on the principles specified in Article 3 and the conditions for establishing new villages and new residential groups in Article 7 of the draft Circular, the Provincial People's Committee directs the District People's Committee to assign the Commune People's Committee to develop a project to establish new villages and new residential groups. The main contents of the Project include:

- The need to establish new villages and new residential groups;

- Name of new village, new residential group;

- Population (number of households, number of people) of the new village, new residential group;

- Other conditions specified in Point b, Clause 1, Article 7 of the draft Circular;

- Suggestions and recommendations.

(2) The Commune-level People's Committee organizes to collect opinions from all voters or voters representing households in the area to establish new villages and new residential groups on the Project to establish new villages and new residential groups; synthesize opinions and compile a minutes of consultation on the Project.

(3) Project to establish a new village or new residential group if more than 50% of voters or voters representing households in the area agree to establish a new village or new residential group, the Commune-level People's Committee completes the dossier (accompanied by a record of voter consultation) and submits it to the Commune-level People's Council for approval at the nearest meeting.

  Within five working days from the date of the Resolution of the Commune-level People's Council, the Commune-level People's Committee completes the dossier and submits it to the District-level People's Committee.

Where the urban government model is organized, within ten working days from the date of collecting opinions from voters or household representative voters, the Commune-level People's Committee completes the dossier to establish a new village and new residential group (accompanied by a record of voter consultation) and submits it to the district-level People's Committee.

In case the Project has not reached the approval of more than 50% of voters or voters representing households in the area where a new village or new residential group is established, the Commune-level People's Committee will organize a second consultation; If more than 50% of voters or voters representing households still do not agree, then within five working days from the date of the second opinion collection record, the Commune-level People's Committee reports to the District-level People's Committee for consideration and decision.

(4) Within ten working days from the date of receipt of complete and valid documents transferred by the Commune-level People's Committee, the District-level People's Committee shall submit a Proposal (attached with the dossier to establish a new village or new residential group of the commune-level People's Committee) sent to the Department of Home Affairs for appraisal and submission to the Provincial People's Committee. The appraisal time limit of the Department of Home Affairs shall not exceed fifteen working days from the date of receipt of the Proposal and dossier of the district-level People's Committee.

(5) Documents submitted to the Provincial People's Committee include:

- Report of the district People's Committee (enclosed with the Proposal and dossier to establish a new village or new residential group from the Commune-level People's Committee to the District-level People's Committee according to the provisions of Clause 1, Clause 2 and Clause 3 of this Article);

- Appraisal document of the Department of Home Affairs.

(6) Based on the dossier submitted by the district People's Committee and the appraisal results of the Department of Home Affairs, the Provincial People's Committee submits it to the People's Council at the same level for consideration and issuance of a Resolution to establish new villages and new residential groups.
