The National Assembly of Vietnam passed the Law on Promulgation of Legislative Documents 2025 (Law No. 64/2025/QH15) on February 19, 2025.

Procedures of reviewing and approving draft Laws and Resolutions of the National Assembly of Vietnam from April 1, 2025

According to Article 40 of the Law on Promulgation of Legislative Documents 2025, the procedures of reviewing and approving draft Laws and Resolutions of the National Assembly of Vietnam are as follows:

- The proposing agency presents the proposal.

- The leading verification agency presents the verification report.

- The National Assembly discusses at the plenary session. Before discussing at the plenary session, the project may be discussed in the National Assembly Deputies' Group.

- During the discussion, the proposing agency explains issues related to the project raised by National Assembly deputies.

- For significant issues or major aspects of the project with differing opinions, the National Assembly votes based on the proposal of the proposing agency or upon the recommendation of the Standing Committee of the National Assembly as a basis for amendments.

- The General Secretary of the National Assembly - Chairman of the Office of the National Assembly organizes the compilation of opinions from National Assembly deputies and the voting results in cases stipulated in clause 5, Article 40 of the Law on Promulgation of Legislative Documents 2025 to send to the proposing agency and the leading verification agency.

- The process of studying, absorbing, explaining, and amending the draft laws and resolutions is conducted as follows:

+ The proposing agency presides, in cooperation with the Standing Committee of the leading verification agency and related agencies and organizations to study, absorb, explain, amend the draft, and prepare the report on assimilation, explanation, and amendment of the draft laws and resolutions to present to the Standing Committee of the National Assembly for opinions; The Standing Committee of the leading verification agency reports to the Standing Committee of the National Assembly on the content the proposing agency expects to absorb, explain, and amend the draft laws and resolutions;

+ The proposing agency presides, in cooperation with the Standing Committee of the leading verification agency and related agencies and organizations to study, absorb, explain, and amend the draft laws and resolutions according to the opinions of the Standing Committee of the National Assembly;

+ No later than 3 days before the National Assembly votes for passage, the proposing agency presides, in cooperation with the Standing Committee of the leading verification agency and related agencies and organizations, to complete the review, finalize the language, format, and technical presentation of documents for the draft laws and resolutions, and submit to the National Assembly;

+ In case the proposing agency has different opinions from the Standing Committee of the National Assembly or the project has important, complex content requiring additional time for study, absorption, and amendment, the Standing Committee of the National Assembly, either on its own or based on the proposing agency's proposal, reports to the National Assembly to consider and decide to postpone the presentation for the National Assembly to pass in the subsequent session or to resubmit.

- The proposing agency reports to the National Assembly on the absorption, explanation, and amendment of the draft laws and resolutions.

- The National Assembly votes to pass the draft laws and resolutions. If the draft still has issues with differing opinions, the National Assembly votes on those issues based on the recommendation of the Standing Committee of the National Assembly before voting on the full text of the draft.

- The Chairman of the National Assembly signs to certify the laws and resolutions of the National Assembly.

- If the draft laws and resolutions are not passed, the National Assembly will consider and decide to postpone the passage to continue perfecting it, presenting it to the National Assembly for passage in the next session or resubmitting.

- The perfection and presentation to the National Assembly for passing the draft laws and resolutions in subsequent sessions will be implemented according to the stipulations of Article 41 of the Law on Promulgation of Legislative Documents 2025. The resubmission is carried out according to the stipulations in Articles 37, 38, and 40 of the Law on Promulgation of Legislative Documents 2025; the project dossier and deadline for sending the project dossier are carried out according to stipulations in clause 1 and clause 3, Article 39 of the Law on Promulgation of Legislative Documents 2025.
