The Government of Vietnam issued Decree 143/2024/ND-CP on November 1, 2024, outlining the regulations for voluntary occupational accident insurance for employees not covered by employment contracts.

Who is eligible to register for voluntary occupational accident insurance in Vietnam?

According to Clause 1, Article 2 of Decree 143/2024/ND-CP, employees aged 15 and above, not covered by mandatory social insurance for occupational accidents and occupational diseases, can register for voluntary occupational accident insurance starting January 1, 2025.

Procedures for registering for voluntary occupational accident insurance in Vietnam

(1) Registration dossier for voluntary occupational accident insurance

The initial registration dossier for voluntary occupational accident insurance is the Social Insurance Participation Declaration of the employee. This must include specific information about the occupation, job, time, and place of work registered for voluntary occupational accident insurance participation.

In case of changes in occupation, job, time, and place of work, information must be adjusted according to the provisions of Article 15 of Decree 143/2024/ND-CP.

(Clause 1, Article 14 of Decree 143/2024/ND-CP)

(2) Implementation process:

employees submit the registration dossier for voluntary occupational accident insurance to the social insurance agency.

Within 7 days from the date of receiving the complete dossier as prescribed, the social insurance agency is responsible for issuing the social insurance book to the employee.

In case of adjustment of the social insurance information of the employee, within 10 days from the receipt of the complete dossier as prescribed, the social insurance agency must reissue the social insurance book. If not resolved, a written response stating the reasons must be provided.

Rights of employees participating in voluntary occupational accident insurance in Vietnam

At Article 32 of Decree 143/2024/ND-CP, employees participating in voluntary occupational accident insurance shall have the following rights:

- To participate in and enjoy the social insurance benefits as prescribed in this Decree.

- To be issued and manage the social insurance book.

- To receive voluntary occupational accident insurance policies in full, promptly, through one of the following payment methods:

+ Directly from the social insurance agency or an authorized service organization;

+ Through a payment account of the employee opened at a bank.

- To authorize others to receive voluntary occupational accident insurance benefits.

- To receive information from the social insurance agency regarding contributions and entitlements to social insurance.

- To receive State support for voluntary occupational accident insurance contributions as specified in Decree 143/2024/ND-CP, specifically for employees not covered by employment contracts participating in voluntary occupational accident insurance. The State supports contributions as a percentage (%) of the occupational accident insurance contribution. To be specific:

+ 30% for participants in voluntary occupational accident insurance from poor households according to rural area poverty standards;

+ 25% for participants in voluntary occupational accident insurance from near-poor households according to rural area near-poverty standards;

+ 10% for other employees.

- To lodge complaints, denounce and initiate lawsuits concerning social insurance as provided by law.
