Regarding this matter, LawNet would like to answer as follows:

On March 18, 2024, the Minister of Planning and Investment issued Decision 321/QD-BKHDT announcing new administrative procedures in the field of contractor selection and investor selection under the Ministry of Planning and Investment.

Procedures for updating account information of organizations and individuals on the Vietnam National E-Procurement System

The procedures for updating account information of organizations and individuals on the Vietnam National E-Procurement System is as follows:

(1) Peocedures:

- Step 1: Contractors and investors update account information on the system.

+ Contractors, investors log in to their accounts on the system at the address https://muasamcong.mpi.gov.vn.

+ Contractors, investors self-declare and supplement/modify the necessary information to be updated, including approved information when registering to participate in the system, roles in bidding activities, and participation status (termination, suspension, temporary restoration).

+ Contractors, investors digitally sign the Request Form for updating information on the system or print the Request Form from the system, sign, affix the seal (if any), and attach a scanned copy of the form on the system.

- Step 2: Receive the result of processing the request to update information via email.

(2) Implementation method:

- Contractors, investors update information on the system and submit the Request Form for updating information on the system according to the User Guide.

(3) Document components:

- Organizations, individuals submit the Request Form for updating information, signed and sealed (if any) by the legal representative of the organization or individual.

(4) Number of documents: 01 set of documents.

(5) Processing time: 02 working days from the date of receiving complete documents.

(6) Implementing agency:

- National Online Bidding Center - Bidding Management Agency - Ministry of Planning and Investment.

(7) Subjects performing administrative procedures:

- Organizations, individuals related to bidding activities.

(8) Results of administrative procedure implementation:

- Information about contractors and investors is updated on the system.

(9) Template name, declaration form (attached):

- Being implemented according to the template available on the system and guided during the information update process.

(1) Legal basis of administrative procedure:

- Law on Bidding No. 22/2023/QH15;

- Decree 24/2024/ND-CP dated February 27, 2024, detailing certain provisions and measures for the implementation of the Law on Bidding regarding contractor selection.

Requirements for Vietnam National E-Procurement System (VNEPS)

- Information published on VNEPS must be made publicly available and accessed without limitation.

- Time source of VNEPS shall comply with regulations of law on national standard time source.

- VNEPS must be operated in a continuous, uniform, stable and safe manner and is capable of user authentication, and data confidentiality and integrity.

- Information on transactions conducted on VNEPS must be sufficiently recorded and can be easily tracked.

- VNEPS must be operated in a manner ensuring that bidders/investors cannot send their EOIs, prequalification applications, bids or proposals to procuring entities after deadlines for submission of bids.

- Information on contractors/investors may be obtained from the national enterprise registration information system, tax administration information system, budget and treasury management information system and other systems. VNEPS shall be connected with web portals and other information systems for the purposes of sharing data and information used in online bidding and serving state management of bidding activities.
