On May 26, 2014, the Minister of Planning and Investment signed and approved Circular 03/2014/TT-BKHDT which provides guidance on the registration of cooperatives and policies for reporting on the operational status of cooperatives.
The temporary suspension of operations of cooperatives, branches, representative offices, business locations of cooperatives is carried out in accordance with the procedures stipulated in Circular 03/2014/TT-BKHDT, specifically:
- When suspending the operations of a cooperative, temporarily suspending the operations of branches, representative offices, or business locations of a cooperative, the cooperative must send a notification to the cooperative registration authority where the certificate of cooperative registration, certificate of branch registration, representative office registration, or business location registration was issued for the cooperative at least 15 days before temporarily suspending operations.- Attached to the notification is the resolution of the general assembly of members or the written decision of the board of directors regarding the temporary suspension of operations of the cooperative, temporary suspension of operations of branches, representative offices, and business locations of the cooperative.- Upon receiving the notification, the cooperative registration authority will issue a receipt and file into the cooperative’s registration dossier for monitoring.- After the notified period expires, if the suspension of operations continues, the cooperative must notify the cooperative registration authority again. The total continuous suspension period shall not exceed one year.
