Based on Article 41 of Decree 125/2024/ND-CP, the procedures for the dissolution of a community learning center in Vietnam from November 20, 2024 are as follows:
The center shall be dissolved when it falls under one of the following cases:
(1) Serious violations of the regulations on management, organization, and operation of the center;
(2) The suspension period has expired, but the causes leading to the suspension have not been remedied;
(3) The objectives and activity content in the center’s establishment decision are no longer suitable for socio-economic development needs;
(4) Failure to ensure educational quality;
(5) At the request of the organization or individual who established the center.
Regarding authority, the Chairman of the district-level People's Committee decides the dissolution of public community learning centers; the Head of the Department of Education and Training decides the dissolution of private community learning centers.
Regarding dossier components:
- For centers dissolved under cases (1), (2), (3), and (4), the dossier includes:
+ A proposal for dissolution by the Department of Education and Training (according to Form 06 of Appendix I attached to this Decree);
+ Evidence of the center violating regulations at points (1), (2), (3), and (4);
+ Plan for handling organizational structure, personnel, finance, assets, land, and other related issues;
- For centers dissolved under case (5), the dossier includes:
+ A proposal for dissolution by the organization or individual (according to Form 06 of Appendix I attached to Decree 125/2024/ND-CP);
+ Dissolution scheme of the center (according to Form 07 of Appendix I attached to Decree 125/2024/ND-CP).
Procedure for the dissolution of community learning centers:
- Step 1:
+ For centers dissolved under cases (1), (2), (3), and (4):
Upon detecting violations of regulations (1), (2), (3), and (4), the Department of Education and Training shall conduct an inspection to assess the center's operations, prepare an inspection report, and notify the center;
Within 5 working days from the inspection date, the Department of Education and Training submits the dossier to the Chairman of the district-level People's Committee for consideration, to decide on the dissolution of public centers, or to the Head of the Department of Education and Training for consideration and decision on the dissolution of private centers;
+ For centers dissolved under case (5):
For public centers, the Department of Education and Training, in cooperation with relevant agencies, prepare a dossier to submit to the Chairman of the district-level People's Committee for consideration and decision.
Within 5 working days from the receipt of the document from the Department of Education and Training, the Chairman of the district-level People's Committee considers and decides on the dissolution of the center.
For private centers, the organization or individual sends one set of dossiers via online public services portal, postal service, or directly to the Department of Education and Training.
Within 5 working days from the receipt of the complete dossier, if the dossier is invalid, the Department of Education and Training shall notify in writing the necessary corrections and supplements to the organization or individual; if the dossier is valid, the Department of Education and Training shall appraise the dossier requesting the dissolution of the center and prepare an appraisal report within 15 days.
Within 5 working days from the appraisal report, the Head of the Department of Education and Training considers and decides on the dissolution of the community learning center; if dissolution is not decided, they shall notify in writing to the organization or individual proposing the dissolution, stating the reasons.
- Step 3: The decision to dissolve the community learning center (according to Form 10 of Appendix I attached to Decree 125/2024/ND-CP) is publicly announced in the media.
