On September 11, 2024, the Government of Vietnam issued Decree 112/2024/ND-CP detailing regulations on rice cultivation land in Vietnam.

Procedures for the crop and livestock structure shift occurring on rice cultivation land in Vietnam

According to Article 8 of Decree 112/2024/ND-CP, the application and procedures to convert crop and livestock structure on rice cultivation land in Vietnam are as follows:

- Users of rice cultivation land who wish to convert to perennial crops, rice combined with aquaculture, shall submit a Registration Form for crop and livestock structure shift occurring on rice cultivation land (hereinafter referred to as the Registration Form) to the commune-level People's Committee according to the Appendix IV template issued with Decree 112/2024/ND-CP.

- Within 05 working days from the date of receipt of a valid Registration Form for crop and livestock structure shift occurring on rice cultivation land, the commune-level People's Committee shall review the conformity of the Registration Form with the annual Plan for crop and livestock structure shift occurring on rice cultivation land of the commune level.

+ If the Registration Form conforms to the annual Plan for crop and livestock structure shift occurring on rice cultivation land of the commune level, the commune-level People's Committee shall issue a written approval for conversion according to the Appendix V template issued with Decree 112/2024/ND-CP and send it to the land user who registered;

+ If the Registration Form does not conform to the annual Plan for crop and livestock structure shift occurring on rice cultivation land of the commune level, the commune-level People's Committee shall notify in writing according to the Appendix VI template issued with Decree 112/2024/ND-CP and send it to the land user who registered.

Principles for crop and livestock structure shift occurring on rice cultivation land in Vietnam

Specifically: according to Clause 1, Article 6 of Decree 112/2024/ND-CP, the crop and livestock structure shift occurring on rice cultivation land in Vietnam must adhere to the following principles:

- Conformity with the provisions of Clause 1, Article 56 of the 2018 Crop Production Law. To be specific:

+ Conformity with the local land use planning, market demand, water source conditions, and climate;

+ Formation of concentrated production areas for each crop type linked with land consolidation, land exchange, and production linkages according to value chains;

+ Ensuring effective utilization of existing infrastructure; conformity with the planning and orientation for completing agricultural production infrastructure of the locality;

+ Ensuring the conditions necessary for reverting to rice cultivation remain intact.

- The crop and livestock structure shift occurring on rice cultivation land to perennial crops is only allowed for the remaining rice cultivation land;

- crop and livestock structure shift occurring on rice cultivation land is not allowed in areas planned for high-yield, high-quality rice cultivation;

- Conformity with the Plan for crop and livestock structure shift occurring on rice cultivation land issued by the competent authority;

- Not causing pollution, degradation of rice cultivation land; not damaging transportation projects, irrigation projects, dike works, or works directly serving rice production;

- Not affecting the cultivation of adjacent rice cultivation land.

Plan for crop and livestock structure shift occurring on rice cultivation land in Vietnam

According to Article 7 of Decree 112/2024/ND-CP, the plan for crop and livestock structure shift occurring on rice cultivation land in Vietnam is as follows:

- The provincial-level People's Committee, According to the provincial land use planning and plan approved by the competent authority as prescribed by law, the proposals of the district-level People's Committee, and the recommendations of the provincial agricultural specialist agency, shall issue the plan for crop and livestock structure shift occurring on rice cultivation land for the entire province according to the Appendix I template issued with Decree 112/2024/ND-CP. The issuance time is before November 30 of the preceding year of the planned year.

- The district-level People's Committee, According to the Plan for crop and livestock structure shift occurring on rice cultivation land approved by the provincial-level People's Committee, the proposals of the commune-level People's Committee, and the recommendations of the district agricultural specialist agency, shall issue the plan for crop and livestock structure shift occurring on rice cultivation land for the entire district according to the Appendix II template issued with Decree 112/2024/ND-CP. The issuance time is before December 15 of the preceding year of the planned year.

- The commune-level People's Committee, According to the Plan for crop and livestock structure shift occurring on rice cultivation land approved by the district-level People's Committee and the conversion needs of the rice cultivation land users, shall issue the local plan according to the Appendix III template issued with Decree 112/2024/ND-CP. The issuance time is before December 30 of the preceding year of the planned year.
