Procedures for the annual approval of number of employees in public service providers in Vietnam (Internet image)
To be specific, Decree 106/2020/ND-CP stipulates the sequence for the approval of the annual staffing numbers in public service providers in Vietnam. To be specific:
- Public service providers with full autonomy over recurrent and investment expenditures and public service providers with full autonomy over recurrent expenditures shall establish the annual staffing plans based on the staffing quotas and guidelines from competent authorities relevant to their sector or field; organize an evaluation and submit it to the head of the public service provider for approval. If a public service provider has a management board, the head must submit the staffing plans to the management board for approval before the final decision.
- Public service providers partially covering their own recurrent expenditures and public service providers ensured by the state budget
- Based on the staffing quotas and guidelines from competent authorities relevant to their sector or field, a public service provider shall draft the annual staffing plan for employees paid from the state budget and report it to the higher supervisory body, which will then report to the designated bodies specified in this section. For public service providers partially covering their own recurrent expenditures, the staffing plan includes staff paid by the state budget and staff paid by service revenues
.- Agencies and organizations assigned with personnel organization tasks of ministries, central authorities, and local authorities shall receive the dossiers, organize an evaluation of the staffing numbers of public service providers, and consolidate the staffing numbers in public service providers partially covering their own recurrent expenditures and public service providers ensured by the state budget. These shall be submitted to the heads of ministries, central authorities, and local authorities for submission to the Ministry of Home Affairs for evaluation.
- The Ministry of Home Affairs shall evaluate the staffing plans for personnel paid from the state budget in public service providers partially covering their own recurrent expenditures and public service providers ensured by the state budget of ministries, central authorities, and local authorities.
- Ministers, heads of Ministerial-level agencies, heads of agencies under the Government of Vietnam, heads of organizations established by the Government of Vietnam or the Prime Minister that are not public service providers, the Directors of Vietnam National University, Hanoi, and the Directors of Vietnam National University, Ho Chi Minh City shall decide and allocate the staffing quotas paid from the state budget to each public service provider under their management complying with the evaluated quotas; and decide and allocate staffing quotas paid from service revenues for public service providers partially covering their own recurrent expenditures under their management.
- The Provincial People's Committee shall submit to the People's Council at the same level to approve the staffing quotas paid from the state budget for public service providers partially covering their own recurrent expenditures and public service providers ensured by the state budget under their management, in total staffing numbers evaluated by the Ministry of Home Affairs; decide the allocation of staffing quotas paid from the state budget to each public service provider under their management within the total staffing numbers approved by the People's Council, and decide the allocation of staffing quotas paid from service revenues for public service providers partially covering their own recurrent expenditures under their management.
