From November 20, 2024, a secondary school falling into one of the cases subjected to suspension of educational operations will be suspended in accordance with the procedure outlined below.

On October 5, 2024, the Government of Vietnam promulgated Decree 125/2024/ND-CP stipulating conditions for investment and operation in the field of education. Decree 125/2024/ND-CP applies to: Preschool education institutions; independent child groups, independent kindergarten classes, independent nursery classes; general education institutions; continuing education institutions; centers supporting inclusive education development; specialized schools; colleges implementing vocational education activities for teacher training at college level; higher education institutions; educational quality assessment organizations; study abroad consultancy service businesses; other organizations and individuals conducting educational operations.

According to Article 29 Decree 125/2024/ND-CP, the Head of the Department of Education and Training in Vietnam decides to suspend educational operations for secondary schools; the Director of the Department of Education and Training decides to suspend educational operations for high schools in the following cases:

- Fraudulent acts to obtain permission for educational operations;

- The person granting permission for educational operations without proper authority;

- Failure to conduct educational operations within 1 year from the date of permission;

- Violations of legal regulations on education that lead to administrative sanctions requiring a suspension of educational operations;

- Other violations according to the law in Vietnam.

The procedures to suspend educational operations of secondary schools in Vietnam are as follows:

- Step 1: Upon detecting a secondary school violating regulations in any of the above cases leading to suspension, the Head of the Department of Education and Training or the Director of the Department of Education and Training organizes an inspection to assess the actual status of the secondary school, makes an inspection report and notifies the school of the violation;

- Step 2: Within 15 days from the notification date to the school regarding the violation, the Head of the Department of Education and Training or the Director of the Department of Education and Training decides on the level of violation, suspends the school's educational operations, and reports to the person with authority to establish or allow the establishment of the school.

The decision to suspend educational operations for secondary schools (according to Form No. 10 Annex I attached to Decree 125/2024/ND-CP) is publicly announced in the media;

- Step 3: During the suspension period, if the reason for the suspension is rectified, the secondary school must inform in writing with evidence to the Head of the Department of Education and Training or the Director of the Department of Education and Training. Within 7 working days from receiving the school's notification, the Head of the Department of Education and Training or the Director of the Department of Education and Training decides to allow the school to resume educational operations and publicly announces this in the media;

- Step 4: In cases of suspension due to unauthorized granting of educational activity permission, within 5 working days from the decision date to suspend, the Head of the Department of Education and Training or the Director of the Department of Education and Training reviews the educational operation conditions of the secondary school. If the conditions meet the regulations in Article 27 Decree 125/2024/ND-CP, then they decide to allow the school to resume educational operations and publicly announce this in the media.
