The following article discusses the procedures for suspension of educational activities of preschools in Vietnam from November 20, 2024, as stipulated in Decree 125/2024/ND-CP.

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating conditions for investment and activities in the field of education.
According to Clause 3, Article 6 of Decree 125/2024/ND-CP, the procedures for suspension of educational activities of preschools in Vietnam is as follows:
- The preschool sends one set of documents as stipulated in Clause 2, Article 6 of Decree 125/2024/ND-CP via online public service, postal service, or directly to the Department of Education and Training;
- Within 5 working days from the date of receiving complete documents, the Department of Education and Training will notify in writing the contents requiring revision or supplementation to the preschool in case the documents are invalid; or inform the plan for an on-site inspection at the preschool if the documents are valid;
- Within 15 days from the date of receiving complete valid documents, the Department of Education and Training shall preside, cooperate with relevant specialized departments to organize an on-site inspection of conditions for the preschool to conduct educational activities according to regulations; prepare an assessment report to evaluate the compliance with the provisions of Article 5 of Decree 125/2024/ND-CP;
- Within 5 working days from the date of the assessment report, if the conditions are met, the Head of the Department of Education and Training will decide to allow the preschool to conduct educational activities; if conditions are not met, a written notice will be issued to the preschool stating the reasons.
The decision allowing the preschool to conduct educational activities will be publicly announced on mass media.
Additionally, the dossier to suspend educational activities includes:
- A proposal for allowing the preschool to conduct educational activities;
- Copies of legal documents proving land use rights, home ownership, or a lease agreement for the preschool site with a minimum term of 5 years;
- For private preschools, there must be a legal document confirming the amount of investment under the school's management, ensuring legality and suitability with the projected scale at the time of registration for educational activities;
- The organization's rules and operational regulations, including key contents: Legal position, duties, powers of the school; organization and management of the school; organization of nurturing, caring, educating children; duties and rights of management staff, teachers, employees, and children; finance and assets of the school; other issues related to the organization and operation of the school. The conditions for establishing nursery schools, kindergartens, public preschools, or permitting the establishment of private, semi-public preschools (collectively referred to as preschools) are specifically stipulated in Article 3 of Decree 125/2024/ND-CP including:
- There is a proposal for establishing or permitting the establishment of a preschool in line with the provincial planning and relevant local planning where the school is to be located.
- The scheme clearly defines the objectives, tasks, preschool education programs, and content; land, facilities, equipment, proposed location for school construction; organizational structure; resources and finances; strategic direction for building and developing the preschool.
More details can be found in Decree 125/2024/ND-CP, which comes into force in Vietnam from November 20, 2024.
