On June 10, 2024, the Chief Procurator of the Supreme People's Procuracy of Vietnam issued Decision 185/QD-VKSTC on the promulgation of the organizational and operational regulations of the Inspectorate of the Supreme People's Procuracy of Vietnam.

Procedures for submitting and handling tasks of Head of the Inspectorate of the Supreme People's Procuracy of Vietnam

In Article 20 of the Regulation issued along with Decision 185/QD-VKSTC, dated June 10, 2024, the procedures for submitting and handling tasks by the Head of the Inspectorate of the Supreme People's Procuracy of Vietnam are stipulated as follows:

  • Procedures for submitting to the Chief Inspector and Deputy Chief Inspector for resolution:
  • Documents, proposals to the leaders of the Supreme People's Procuracy of Vietnam, documents sent to units under the Supreme People's Procuracy of Vietnam, high-level People's Procuracies, provincial-level People's Procuracies, relevant individuals, and organizations must be checked and commented on by department leaders, signed on/check-in according to the law and the People's Procuracy sector regulations, along with related documents (if any); the Inspectorate leaders check and sign to submit to the leadership of the Procuracy.

  • For issues related to the functions and duties of other departments, the submission documents must include official written opinions from the relevant departments; proposals from lower-level People's Procuracies must have written opinions from the Chief Prosecutor of that level. If not all related opinions are included, the reasons must be clearly reported in the document/proposal.

  • Submitted documents must clarify the main content, rationale of the proposals, differing opinions. A report explaining the feedback from relevant units, including other advisory opinions (if any), and other necessary documents.

  • Within 5 working days from the receipt of complete procedure documents, they must be submitted to the responsible Deputy Chief Inspector or Chief Inspector for resolution. The suggestion form must clearly, fully, and honestly reflect the opinions of the units, including differing opinions; suggestions from the person directly overseeing and the departmental leader’s opinions. The suggestion form must be accompanied by all necessary documents.

For tasks with stipulated resolution deadlines, the document submission for task resolution must be carried out immediately when procedures are complete.

  • Documents and proposals for task resolution are sent in one original copy to the unit authorized to resolve. If necessary, additional copies can be sent to relevant units for information or coordination, listing those units in the "Recipients" section of the document.

  • For agencies and organizations not under the Inspectorate's management, documents are sent to units according to current law and the People's Procuracy sector regulations on documentation.

Methods of handling tasks by Head of the Inspectorate of the Supreme People's Procuracy of Vietnam

In Article 19 of the Regulation issued with Decision 185/QD-VKSTC, dated June 10, 2024, methods for handling tasks by the Head of the Inspectorate are stipulated as follows:

  • The Chief Inspector and Deputy Chief Inspector consider and resolve work based on task assignment to departments, and departments report work resolutions in a "Proposal Report" according to the Inspection template.

  • The Chief Inspector and Deputy Chief Inspector chair meetings/work with department leaders to gather opinions before resolving significant and necessary issues that can't be handled immediately via the methods defined in Clause 1, Article 19 of the Regulation issued with Decision 185/QD-VKSTC.

  • Other methods of handling tasks include field trips and handling tasks on-site, direct work with departments within their charge, and other methods prescribed or authorized by the Chief Inspector.
