On October 8, 2024, the Government of Vietnam issued Decree 126/2024/ND-CP stipulating the organization, operation, and management of associations in Vietnam.

According to the provisions in Article 27 of Decree 126/2024/ND-CP, the procedures for stale budget supports for assigned tasks in the activities of associations in Vietnam are carried out as follows:

- For duties assigned by central and local authorities with competence in Vietnam:

+ Based on the decision to assign duties by competent authorities to the association, the association develops a proposal or implementation plan (detailing the number and volume of tasks supported by the state budget):

For  associations  operating  nationwide  or  inter-provincially:  the  association  seeks  opinions  from  the  state  management  agency  in  the  main  field  of  the  association's  activity,  the  Ministry  of  Finance,  and  relevant  central  agencies  concerning  the  assigned  duties;  consults  the  Ministry  of  Planning  and  Investment  regarding  requests  for  funding  support  from  central  government  budgets  for  public  investment  tasks  (the  response  time  from  consulted  agencies  is  not  to  exceed  15  working  days);

For  local  associations:  the  association  seeks  opinions  from  specialized  state  management  agencies,  financial  agencies,  planning,  and  investment  agencies,  and  other  relevant  local-level  agencies  (the  response  time  from  consulted  agencies  is  not  to  exceed  15  working  days).

+ After receiving feedback from the consulted agencies, the association completes the proposal or implementation plan (accompanied by the opinions of the consulted agencies):

Submits  to  the  Prime  Minister  of  the  Government  of  Vietnam  to  consider  and  issue  a  decision  assigning  duties  for  associations  operating  nationwide  or  inter-provincially;

Submits  to  the  Chairman  of  the  People's  Committee  at  all  levels  to  consider  and  issue  a  decision  assigning  duties  for  associations  operating  at  provincial,  district,  or  communal  levels  as  decentralized.

+ Based on the decision to assign duties at point b, clause 1, Article 27 of Decree 126/2024/ND-CP:

The  association  prepares  a  budget  estimate  to  be  sent  to  the  financial  agency  at  the  same  level  concerning  support  from  the  regular  expenses  of  the  state  budget  per  the  law  on  the  state  budget.

The  association  prepares  an  investment  plan  to  be  sent  to  the  planning  and  investment  agency  at  the  same  level  for  budget  support  for  developing  investment  from  the  state  budget  to  consolidate  for  submission  to  competent  authorities  as  per  the  public  investment  law.

- For duties funded by the budget within National Target Programs, implementation follows the financial mechanism of that National Target Program.

- For duties assigned by ministries and central authorities to associations, the source of financial support is drawn from the budget of the agency assigning the duties.

- The management, use, and finalization of state budget funds are performed following the provisions of the law on the state budget, public investment law, and relevant legal provisions.

- For associations assigned duties by the Communist Party or the State, implementation is according to the provisions of clauses 2 and 3, Article 39 of Decree 126/2024/ND-CP.

More details can be found in Decree 126/2024/ND-CP which comes into force in Vietnam from November 26, 2024.
