Procedures for settlement of denunciations of the provincial Party Committee in Vietnam under Decision 89-QD/TW (Internet image)

The Central Secretariat of Vietnam issued Decision 89-QD/TW dated December 1, 2022 on the process of inspecting, supervising, enforcing, and handling denunciations and complaints about party discipline by the provincial Party Committee and the equivalent to the grassroots.

Accordingly, the denunciation settlement process of the provincial Party Committee under Decision 89-QD/TW is carried out through the following steps:

1. Preparation for settlement of denunciations of the provincial party committee in Vietnam

- Establish a denunciation settlement team and develop a denunciation settlement plan:

+ The standing committee of the Party committee assigns the representative of the inspection committee or the agency or unit to assist the committee in working with the denunciation writer to grasp the situation and clearly identify the identity and address of the denouncer; the party organization, the denounced party member, and the denunciation (when working with the denouncer, the minutes of the meeting must be made); advising on the establishment of a denunciation settlement team; and developing a complaint resolution plan.

+ Standing committee at all levels to sign and issue decisions and plans to settle denunciations.

The head of the inspection team is a member of the standing committee assigned by the standing committee (for grassroots level and equivalent: The team leader can be the leader of the units or the party member assigned the task of advising and assisting the party committee). Based on the denunciation content, determine the appropriate number of members.

The inspection team may use the seal of the party committee to perform its tasks.

- The inspection team studies the denunciation, based on the contents of the petition and the results of working with the denouncer to develop an outline to request the denounced object to report and explain; working schedule of the delegation and assigning tasks to each member of the delegation; Prepare relevant documents and documents.

- The office of the Party Committee ensures the necessary conditions, funds, and means to serve the delegation in performing the tasks as prescribed (if any).

2. The process for settlement of denunciations of the provincial party committee in Vietnam

- The inspection team or the inspection team's representative implements the decision and plan to settle the denunciation, agrees on the working schedule with the denounced object, and the representative of the party organization manages the party members. To request the denounced subject to prepare reports according to the outline, to provide dossiers and documents; related organizations and individuals to coordinate in implementation.

Based on the actual situation, the implementation of the denunciation settlement decision and plan can be done online or in writing.

- The denounced object shall submit a written explanation report and relevant documents and records to the denunciation settlement subject (committee level, standing committee of the party committee) through the inspection team.

- The inspection team examines and verifies:

+ The inspection team shall research reports, records, documents, and evidence received and work with whistleblowers, organizations, and individuals related to the denunciation contents and denounced subjects.

During the verification and verification process, the inspection team meets and works directly with the denouncer (if necessary) to redefine and further clarify the denunciation contents; guide the denouncer to exercise his/her rights and obligations, explain, supplement, and clarify further (if any); and take measures to protect whistleblowers according to regulations.

In case it is necessary to amend the contents, time, objects of inspection, members of the delegation, or expertise in professional and technical matters, the head of the delegation shall report to the Standing Committee of the Party Committee for consideration and decision.

+ The inspection team develops a draft report on denunciation settlement results.

While carrying out the denunciation settlement process, if the denounced object is detected with other signs of violations, it shall be reported to the Standing Committee of the Party Committee for a decision to switch to inspection when there are signs of violation, put the denunciation contents in the joint report on inspection results when there are signs of violation, draw conclusions; make a file to end the denunciation settlement.

If the violation is clear enough to require disciplinary action, and the denounced subject voluntarily self-reflects and recognizes the disciplinary action commensurate with the violation, the head of the inspection team shall report to the Standing Committee of the Party Committee to decide whether to combine the disciplinary enforcement process with the denunciation settlement process (implementing the dual process).

- Organize a conference for the inspection team to approve the draft report on denunciation settlement results (the party organization that is the object of the accusation or directly manages the denounced party member organizes, presides over, and records the meeting minutes).

+ Composition of the conference: The inspection team, the representative of the denounced party organization or the denounced party member, and the representative of the party organization that directly manages the party member (or depending on the content, the object of the accusation. The head of the inspection team shall decide to organize the party to organize the conference, and the participants).

+ The conference listens to the inspection team submit the draft report on the denunciation settlement results; the denounced object presents his/her explanation and self-recognizes the disciplinary form (if any); conference to discuss and comment on the draft report, the inspection and verification results of the delegation and written recommendations and proposals (if any); Vote to recommend disciplinary action (if any).

- The inspection team continues to verify and verify the unclear contents or have different opinions (if any); exchange with the accused and representatives of relevant party organizations and members on the contents of inspection and verification to have enough grounds to conclude whether there is a violation or not or to consult the inspection committee at the same level (if necessary); finalize the draft report on denunciation settlement results.

- The inspection team shall coordinate with the office of the Party Committee to report to the Standing Committee of the Party Committee to decide on the time to hold the meeting of the Party Committee or the Standing Committee of the Party Committee, and the participants; send reports on the results of the denunciation settlement to comrades-in-arms or members of the standing committee according to the working regulations.

3. Final step of settlement of denunciations of  the provincial Party Committee

- Holding a meeting of the standing committee of the party committee or committee to consider and conclude:

+ The inspection team shall report on the results of the denunciation settlement (if it is within the competence of the Party Committee to make conclusions, the standing committee of the Party Committee shall give instructions before the inspection team submits it to the Party Committee); fully present the opinions of the denounced object and the denouncer, relevant organizations and individuals; and make suggestions and recommendations.

+ Standing Committee of the Party Committee considers and draws conclusions; votes to decide on the form of discipline, or requests the competent authority to discipline the violating party organization or party member (if any).

- The inspection team completes the report on denunciation settlement results; coordinates with the office of the Party Committee to draft a notice of the conclusion of the denunciation settlement and the disciplinary decision or report to the competent authority to take disciplinary action against the denounced object (if any), and submits it to the standing committee for signature and promulgation.

- The representative of the standing committee of the Party Committee shall notify the denunciation settlement conclusion and disciplinary decision (if any) to the denounced object and related organizations and individuals, or implement disciplinary procedures (if any).

Based on the actual situation, the notification of conclusions can be done online or in writing.

The representative of the inspection team shall coordinate with the unit or individual in charge of receiving people from the Party Committee to notify the denunciation settlement conclusion in an appropriate form to the denouncer.

- The inspection team meets to draw on its experience; make recommendations and proposals to the Party Committee or the Standing Committee of the Party Committee (if any); complete the dossier, and hand it over to the authorized office for storage according to regulations.

- Assigning the inspection committee of the party committee at the same level and the comrades at the same level to monitor the area and field to urge and supervise the denounced object to implement the decision, conclude the denunciation settlement.

Decision 89-QD/TW takes effect from the date of signing and promulgation.
