Procedures for selection of members of the Security and order protection team in Vietnam (Internet image) 

On June 28, 2024, the Ministry of Public Security (Hanoi, Vietnam) issued Decision 4768/QD-BCA to announce new administrative procedures relating to the forces participating in protecting security and order at the grassroots level, within the state management of the Ministry of Public Security (Hanoi, Vietnam).

Procedures for selection of members of the Security and order protection team in Vietnam

- Step 1: Citizens study the Team Member Selection Plan for the Security and Order Protection Team issued by the People's Committee at the commune level, which is publicly posted at the headquarters of the People's Council, the People's Committee, the police at the commune level, at the cultural house, and at community activity points in villages and neighborhoods; prepare the dossier according to regulations.

- Step 2: Submit the dossier to the police at the commune level at the time and place announced.

- Step 3: Receive the dossier and publicly announce the list of candidates:

  • The police at the commune level organize to receive the application dossier. If the dossier is incomplete or irregular, the dossier reception unit must notify immediately upon reception and guide to complete the dossier as per regulations;

  • At the end of the period for receiving the dossier, the police at the commune level compile a list of candidates, report to the People's Committee at the same level for approval, and publicly post the list of candidates at the headquarters of the People's Council, the People's Committee, the police at the commune level, at the cultural house, and at community activity points in villages and neighborhoods within 15 working days before the selection meeting.

- Step 4: Establish the Selection Council:

The Chairman of the People's Committee at the commune level decides to establish the Selection Council. The council comprises the Chairman (a representative of the commune-level People's Committee leadership), the Vice-Chairman (the Head or Deputy Head of the commune-level police), members representing: the Ho Chi Minh Communist Youth Union at the commune level, the Vietnam Women’s Union at the commune level, the Vietnam Farmers’ Union at the commune level, the commune-level official, and representatives of the village or neighborhood, the Front Work Committee in the village or neighborhood (hereinafter collectively referred to as members of the Selection Council). The number of members in the Selection Council is decided by the Chairman of the People's Committee at the commune level.

- Step 5: Organize the selection meeting:

  • The time for organizing the selection meeting is after the public listing period of candidates has ended and is decided by the Chairman of the Selection Council regarding the time;

The Selection Council meets when more than half of the total members of the Selection Council are present and must be attended by the Chairman of the Selection Council or the authorized Vice-Chairman to preside over the meeting.

  • The selection content is based on the criteria and conditions specified in Article 13 of the Law on Forces Participating in the Protection of Security and Order at the grassroots level and selection dossier according to regulations in this Circular.

- Step 6: Sequence of operations at the meeting:

  • In case of secret ballot voting, the ballot template is stamped by the commune-level People's Committee. The Selection Council introduces a Counting Committee including the Chair, Vice-Chair, Member, and Secretary of the Counting Committee. The Counting Committee counts immediately after voting ends and makes a Minutes of the selection results, endorsed by the Counting Committee Chair, Secretaries, and publicly announces at the meeting.
  • The Chairman of the Selection Council or the authorized Vice-Chairman declares the reason, states the purpose, requirement, content of the meeting, and announces: The list, background of the candidates; criteria, conditions for joining the forces participating in the protection of security and order at the grassroots level according to regulations; the list of members of the Selection Council; form of selection; meeting secretary and other relevant content;

In case of open voting by raising hands, the meeting secretary counts the number of members present voting and makes a Minutes of the selection results, endorsed by the Chairman of the Selection Council or the authorized Vice-Chairman, the meeting secretary, and announces publicly at the meeting.

- Step 7: Selection results and public announcement:

  • Candidates are selected to be recommended for recognition as members of the Security and Order Protection Team and must be approved by more than half of the members of the Selection Council present at the meeting by vote or secret ballot.

If the number of candidates approved by more than half of the present members exceeds the required number of team members, the number of team members is taken in order from high to low until the required number is met.

In case of a tie vote or secret ballot, the Chairman or authorized Vice-Chairman of the Selection Council will decide.

  • Within 03 working days from the date of completing the selection minutes, the police at the commune level publicly post the selection minutes at the headquarters of the People's Council, the People's Committee, the police at the commune level, at the cultural house, and at community activity points in villages and neighborhoods, and notify the selection result to the address of the candidates, informing the time to report for duty if selected.
