On June 25, 2024, the Government issued Decree 70/2024/ND-CP detailing certain provisions and measures to implement Law on citizen ID cards 2023.

Procedures for revocation of Vietnamese citizen ID cards from July 1, 2024

Article 22 of Decree 70/2024/ND-CP stipulates the sequence and procedures for revoking citizen ID cards as follows:

Procedures for revoking citizen ID cards of citizens deprived of Vietnamese nationality, renouncing Vietnamese nationality, or whose decision to grant Vietnamese nationality is annulled.

  • The receiving agency, when executing the procedure for depriving Vietnamese nationality, allowing renunciation of Vietnamese nationality, or annulling the decision to grant Vietnamese nationality, shall make a record of the revocation of Vietnamese citizen ID cards for persons subject to such measures;

  • Within 10 days from the date of the decision to deprive Vietnamese nationality, allow renunciation of Vietnamese nationality, or annul the decision to grant Vietnamese nationality, the Ministry of Justice shall send a notification enclosing the revoked identity card to the Police Department's identity card management agency.

In case the receiving agency, when executing the procedure for depriving Vietnamese nationality, allowing renunciation of Vietnamese nationality, or annulling the decision to grant Vietnamese nationality, cannot retrieve the identity card, it shall state so in the notification sent to the Police Department's identity card management agency, which will then proceed with verification and retrieval according to regulations;

  • Within 3 working days from receiving the notification from the Ministry of Justice, the Police Department's identity card management agency must invalidate the use of the identity card and update the information of the person whose Vietnamese nationality is deprived, renounced, or annulled in the national population database and the identity card database;

  • If the identity card management agency discovers a person who should have their identity card revoked under point a, clause 1, Article 29 of the Law on citizen ID cards 2023, it must invalidate the use of the identity card, update the information in the national population database and the identity card database, and proceed with revoking the identity card if the person still holds it.

Procedures for revoking citizen ID cards issued incorrectly or tampered with.

  • Upon identifying that an identity card is issued incorrectly or has been tampered with, the agency, organization, or individual must notify the identity card management agency to verify and request the user to surrender the identity card;

  • Within 7 working days, the identity card management agency must verify and revoke the incorrectly issued or tampered identity card and notify the Police Department's identity card management agency.

The National Identity Management Agency of the Ministry of Public Security is responsible for updating the status and locking the electronic identity card for revoked cases.

In cases where the identity card cannot be retrieved, the National Identity Management Agency of the Ministry of Public Security shall still proceed with the updates as stipulated in point c clause 1 and clause 3 of Article 22 of Decree 70/2024/ND-CP.

Decree 137/2015/ND-CP (amended and supplemented by Decree 37/2021/ND-CP) expires when Decree 70/2024/ND-CP takes effect.
