Regarding this issue, LawNet would like to answer as follows:
Medical examination and treatment practitioners must carry out procedures to renew their practicing license at least 60 days before the license expires, as prescribed in Clause 2 of Article 27 of the Law on Medical Examination and Treatment 2023.
Medical examination and treatment Practitioners who do not practice at medical examination and treatment facilities belonging to the people's armed forces must carry out extension procedures at the Ministry of Health or Department of Health.
* Application for renewal of a practicing license includes:
- Application for renewal of practicing license according to Form No. 04, Appendix II attached to Decree 16/2024/ND-CP;
- Practicing license has been issued;
- Documents proving that medical knowledge has been continuously updated in medical examination and treatment, as specified in Article 22 of the Law on Medical Examination and Treatment 2023.
* Procedures for renewing practicing license:
- The person requesting to renew the practicing license sends 01 set of documents according to the above regulations, either directly, by post, or through the electronic environment, to the Military Medical Department/Board at the focal level under the Ministry of National Defense, medical facilities under the Public Security Units, and localities under the Ministry of Public Security.
In case of illness, accident, or force majeure at the time of submitting the renewal application, there must be a written notification to the agency assigned to manage the health to delay the submission of the application for practicing license renewal.
Medical examination and treatment practitioners are asked to postpone the renewal date many times, but the total delay time for renewal must not exceed 22 months, from the date the practicing license expires;
- In case the application is valid, within 05 working days from the date of receipt, the focal point unit under the Ministry of National Defense or the medical facility under the Public Security, units, and localities under the Ministry of Public Security compiles a list to send directly, by post, or in an electronic environment to the agency assigned to manage health care, along with the practitioner's application and a written request from the head of the focal point unit under the Ministry of National Defense or a medical facility under a Public Security unit or locality under the Ministry of Public Security.
In case the application is invalid, within 03 working days from the date of receiving it, the focal point unit under the Ministry of National Defense, the medical facility under the Public Security, the unit or locality under the Ministry of Public Security, or the agency assigned to manage health must have a written response to the unit sending the application, which specifically states the reason for invalidity and requests an amendment or supplementation of documents included in the application. The time for amending and supplementing documents in the application is not included in the processing time limit;
- Within 05 working days from the date of receiving the valid application, the agency assigned to manage the health sector will review the application, complete procedures, and submit it to the competent authority to extend the practicing license. In case you do not renew your practicing license, you must respond in writing and clearly state the reason;
- Within the period from the date of receipt of the report from the assigned health management agency until the expiration date stated on the practicing license, yhe practicing license issuing agency is responsible for renewing or must respond in writing, clearly stating the reason if extension is not carried out. If by the expiration date stated on the practicing license there is no written response, the practicing license will continue to be valid according to regulations.
