Regarding this matter, LawNet would like to answer as follows:
On April 11, 2024, the Ministry of Transport issued Decision 421/QD-BGTVT on the announcement of newly issued administrative procedures related to transportation under the Ministry of Transport.
Procedures for reissuing licenses to transport dangerous goods that are lost or damaged in Vietnam as of May 15, 2024 are as follows:
* Submit application
The individual that uses a land motor vehicle or an inland watercraft to transport dangerous goods (hereafter referred to as "carrier") submits the application to the authority issuing licenses to transport dangerous goods, specifically:
- The Ministry of Public Security organizes the issuance of licenses to transport dangerous goods of types 1, 2, 3, 4, and 9 as prescribed in Clause 1, Article 4 of Decree 30/2024/TT-BGTVT (except for plant protection chemicals and organizations and enterprises under the Ministry of National Defense).
- The Ministry of National Defense organizes the issuance of licenses to transport dangerous goods for organizations and enterprises under the Ministry of National Defense.
- The Ministry of Science and Technology organizes the issuance of licenses to transport dangerous goods of types 5 and 8 as prescribed in Clause 1, Article 4 of Decree 30/2024/TT-BGTVT.
- The People's Committees of provinces and centrally-run cities organize the issuance of licenses to transport dangerous goods for plant protection chemicals.
* Settle administrative procedures
- In case of direct submission: the authority settling administrative procedures checks the applications and provides an immediate response when the organization or individual submits the applications; in cases where the applications are incomplete or incorrect, guidance is given to complete the applications according to regulations.
In case of submission via postal services or through the online public service system: Within a period not exceeding 01 working day from the date of receiving the applications, the authority settling administrative procedures examines the completeness of the applications; if the applications are incomplete according to regulations, the authority settling administrative procedures notifies in writing or through the online public service system to inform the organization or individual to supplement and provide guidance to complete the applications according to regulations;
- Within a period of 02 working days from the date of receiving the complete applications, according to regulations, the authority issuing the License to appraise the applications issues licenses to transport dangerous goods. In the event that the license is not issued, the authority issuing the license must respond in writing or notify through the online public service system and state the reason.
- Applications include:
Application for reissuance of licenses to transport dangerous goods (including the reason: lost or damaged).
- Number of sets of applications: 01 set.
- Competent authority to settle: Ministry of Public Security, Ministry of National Defense, Ministry of Science and Technology, Provincial People's Committees;
- Authorized or delegated authority to implement: None;
- Direct authority to implement administrative procedures: Ministry of Public Security, Ministry of National Defense, Ministry of Science and Technology, Provincial People's Committees;
- Coordinating authority: None.
