Regarding this matter, LawNet would like to answer as follows:

On March 18, 2024, the Minister of Planning and Investment issued Decision 321/QD-BKHDT announcing new administrative procedures in the field of contractor selection and investor selection within the scope of management functions of the Ministry of Planning and Investment.

Procedures for registering to participate in the Vietnam E-Procurement System (central level)

Accordingly, the procedures for registering to participate in the Vietnam E-Procurement System for contractors and investors are regulated as follows:

(1) Procedure sequence:

- Step 1: Register contractor/investor information

+ Contractors/investors register their unit's information on the Vietnam E-Procurement System at the address https://muasamcong.mpi.gov.vn (System);

+ Contractors/investors print out the registration form from the System and submit it along with the required documents as specified in point c, clause 1, item 1 on the System.

- Step 2: Receive the processing result of the registration file and login account information of the participating organization via email.

(2) Method of implementation:

- Contractors/investors enter the registration information generated on the System and submit the registration file on the System following the User Guide.

(3) Components of the registration file:

- Organizations submitting the registration file on the System include the following documents:

(i) The registration form generated on the System, signed and stamped (if applicable) by the legal representative of the organization;

(ii) Power of attorney (if applicable);

(iii) Establishment decision or Business registration certificate or Business household registration certificate or cooperative registration certificate, Joint cooperative registration certificate, cooperative alliance registration certificate, or other equivalent documents in case the organization is not listed on the national enterprise registration information system;

- Individuals submitting the registration file on the System include the following documents:

(i) The registration form generated on the System, signed by the individual registrant;

(ii) Copy of passport or equivalent document for individuals of foreign nationality.

(4) Number of files: 01 set of documents.

(5) Processing time: 02 working days from the date of receiving the complete registration file.

(6) Implementing agency:

- National E-Procurement Center - Department of Procurement Management - Ministry of Planning and Investment.

(7) Subjects performing the administrative procedure:

- Organizations and individuals involved in procurement activities.

(8) Results of administrative procedure implementation:

- Contractors/investors whose names are on the list of contractor/investor databases approved by the System will be granted an Account to participate in the System.

(9) Fee: 330,000 VND (including value-added tax) as prescribed in point a, clause 11, Article 12 of Decree 24/2024/ND-CP dated February 27, 2024, providing detailed regulations on certain provisions and measures for the implementation of the Law on Bidding regarding contractor selection.

(10) Form name, declaration form:

- Follow the form provided on the System's web form and follow the instructions during the registration process.

(11) Legal basis of the administrative procedure:

- Law on Bidding 22/2023/QH15;

- Decree 24/2024/ND-CP, dated February 27, 2024 providing detailed regulations on certain provisions and measures for the implementation of the Law on Bidding regarding contractor selection.
